Which types of fireworks can Vietnamese citizens use during Tet holiday in 2024?

Based on the provisions stipulated in Article 17 of Decree 137/2020/ND-CP as follows:

Use of fireworks

1. Agencies, organizations, and individuals with full civil capacity are permitted to use fireworks in the following cases: festivals, Tet, birthdays, weddings, conferences, inaugurations, anniversaries, and in cultural and artistic activities.

2. Agencies, organizations, and individuals using fireworks must only purchase them from organizations and businesses licensed to produce and trade in fireworks.

According to the provisions stated in point b, clause 1, Article 3 of Decree 137/2020/ND-CP, fireworks are defined as products manufactured, either manually or industrially, that, under the influence of mechanical, thermal, chemical, or electrical stimuli, produce sound, light, and color effects in the air, without causing an explosion.

Individuals with full civil capacity are allowed to purchase and use fireworks through licensed organizations and businesses that are permitted to produce and trade in fireworks.

Currently, the only entity assigned to produce and supply fireworks in our country is the 21 Chemical Single Member Limited Liability Company (Factory Z121) under the Ministry of Defense. Some types of Z121 fireworks listed by the 21 Chemical Single Member Limited Liability Company of the Ministry of Defense from August 1, 2023, are listed below:

Therefore, during Tet 2024, residents are allowed to purchase and use specific types of fireworks produced by Factory Z121 under the Ministry of Defense, including: fountain tubes, firework sticks, spinning flower wheels, waterfall fireworks, firework displays, and twinkling fireworks...

Moreover, these types of fireworks do not emit explosive sounds but create beautiful light and color effects suitable for entertainment purposes. The purchase and use of fireworks must comply with regulations regarding age, identification, and safe usage.

How much will citizens be fined for illegally using explosive fireworks in Vietnam?

According to point i, clause 3, Article 11 of Decree 144/2021/ND-CP, and point a, clause 7, Article 11 of Decree 144/2021/ND-CP, it is provided as follows:

Violations regarding the management and use of weapons, explosives, explosive precursors, support tools, fireworks, and banned dangerous toys

3. A fine ranging from 5,000,000 VND to 10,000,000 VND shall be imposed for one of the following acts:

...

i) Illegal use of fireworks or firework chemicals;

...

7. Additional penalties:

a) Confiscation of the material evidence and means used for administrative violations stated at points d and đ, clause 1; points a, b, c, e, and g, clause 2; points a, c, d, dd, e, h, i, and k, clause 3; points a, b, c, d, dd, e, h, and i, clause 4 and clause 5 of this Article;

Therefore, according to the provisions above, individuals illegally using explosive fireworks can be fined from 5 million VND to 10 million VND.

Additionally, supplementary penalties may include confiscation of the material evidence and means used for administrative violations.

*Note: The fine levels above apply to individuals. For organizations, the fines are double those applicable to individuals.
