Vietnam: When was the physical household registration book annul?

Pursuant to the provisions of Clause 3, Article 38 of the Law on Residence 2020, issued household registration books and temporary residence registers may continue to be used and are equivalent to written confirmations of residence per this Law until December 31, 2022 inclusive.

Before this time, the Ministry of Justice issued Decision 2228/QD-BTP in 2022 announcing newly issued administrative procedures; Administrative procedures to be amended and supplemented in the field of civil status shall be carried out at civil status registration offices under the management functions of the Ministry of Justice.

Accordingly, the Ministry of Justice has issued a decision to abolish 37 procedures, not requiring people to present household registration books and temporary residence books for administrative procedures.

December 21, 2022. The Government has also issued Decree 104/2022/ND-CP amending the Decree related to the submission and presentation of physical household registration books and temporary residence books when performing administrative procedures and providing public services.

This new regulation has abolished regulations on the submission and presentation of physical household registration books and temporary residence books when carrying out administrative procedures and providing public services, mainly in many areas such as employment, insurance, education, healthcare, land, tax, housing, social housing, electricity, adoption...

Thus, from January 1, 2023, physical household registration books and temporary residence books have been officially annulled.

Is it mandatory to apply for a residence certificate instead of a household registration book in Vietnam?

4. Documents proving information about residence include: Citizen identity card, identification card, certification of residence information, notice of personal identification number and citizen information in the National Population Database.

To prove information about residence, citizenscan use one of the following documents:

- Citizen identity card,

- Identification card,

- Certification of residence information,

- Notice of personal identification number and citizen information in the National Population Database.

Thus, the use of the Certificate of Residence Information is considered as a way to replace the household registration book in cases where proof of residence information is required.

However, in the process of implementing regulations to remove household registration books. Some agencies and units often require people to go to the police station to confirm their residence in order to handle some administrative procedures. The reason is that at present, the population database has not been linked or synchronized, so many procedures and transactions still require proof of residency.

In addition, due to the fact that some cadres and civil servants in the process of handling administrative procedures to serve the people, they were also fully informed about methods to replace physical household registration books, temporary residence books, etc. should lead to the requirement of citizens to apply for a certificate of residence.

Opinion on this issue, according to a representative of the Police Department for Administrative Management of Social Order, Ministry of Public Security, said that this frustration of the people is completely understandable.

Because in the case of officials receiving and handling administrative procedures at People's Committees at all levels or functional agencies, even though they are fully qualified, they do not implement other methods to confirm and prove their residence, but still force them to do so. Citizens have to go to the ward police station to apply for a certificate of residence as a "citizen", causing difficulties, slowing down, hindering the process of reforming administrative procedures and implementing the Government's Project 06.

What is the alternative method of using citizen information when annulling the physical household registration book in Vietnam?

In order to uniformly and synchronously implement regulations on not using household registration books and temporary residence books. The Police Department for Administrative Management of Social Order (C06), the Ministry of Public Security has guided 07 methods of using citizen information instead of removing the physical household registration book.

- Using a citizen's identity card with an electronic chip as a legal document to prove information about an individual and his/her permanent residence.

- Using a device that reads the QRCode on the Citizen ID card with the chip attached

- Using chip reader on Citizen ID card

- Look up and exploit personal information online in the National Population Database for use when carrying out administrative procedures and civil transactions by:

- Using the VNeID application to display information on electronic devices to serve the settlement of administrative procedures and civil transactions (according to Decision 34/QD-TTg 2021 of the Prime Minister).

- Using the certificate of residence information (issued together with Circular 56/2021/TT-BCA)

- Using the Notice of personal identification number and information in the National Population Database (according to the provisions of Circular 59/2021/TT-BCA)
