According to Official Dispatch 4267/BQP-TM in 2023, the timeframe for military service delivery and reception in 2024 is as follows:

Pursuant to the Law on Military Service 2015 and Decision 82/QD-TTg in 2023 by the Prime Minister of the Government of Vietnam regarding the conscription in 2024; in 2024, there will be 01 recruitment phase for conscription. The delivery and reception of recruits will take place over three days, from February 25 to the end of February 27, 2024 (from January 16 to January 18 of the Lunar Year of the Dragon).

Thus, for the year 2024, there will be 01 recruitment phase, and depending on each locality, the military service enrollment timeframe will take place over three days from February 25, 2024, to the end of February 27, 2024 (equivalent to January 16 to January 18 of the Lunar Year of the Dragon).

When are Vietnamese Citizens exempted from conscription in 2024?

Under the provisions of Clause 1, Article 41 of the Law on Military Service 2015, supplemented by point c, Clause 1, Article 49 of the Law on Militia and Self-defense Force 2019, the following circumstances provide for deferment of conscription:

- Not having adequate health for active duty based on the Health Examination Council's conclusion;

- Being the only laborer directly responsible for supporting family members who are incapable of working or not of working age; families severely affected by accidents, natural disasters, dangerous epidemics as certified by the commune People's Committee;

- A child of a war invalid, a person affected by Agent Orange with a labor capacity reduction from 61% to 80%;

- Having a sibling who is a non-commissioned officer or soldier currently in active duty; performing obligations to join the People's Police;

- Belonging to a migratory family within the first three years moving to specially difficult communes under socio-economic development projects decided by the provincial-level People's Committee or higher;

- Officials and public employees, young volunteers assigned to work in areas with particularly difficult socio-economic conditions under legal provisions;

- Attending regular elementary or secondary education; enrolled in a regular university course or regular vocational training within a single course duration.

- Regular militia members

Citizens belonging to the above categories are deferred from conscription in 2024.

Additionally, the cases specified in Clause 2, Article 41 of the Law on Military Service 2015 are exempted from conscription in 2024, including:

- Children of martyrs and first-class war invalids;

- One sibling of a martyr;

- One child of a second-class war invalid; a child of a person affected by Agent Orange with a labor capacity reduction from 81% or more;

- Cryptography workers who are not servicemen or People's Police;

- Officials and public employees, young volunteers assigned to work in areas with particularly difficult socio-economic conditions under legal provisions for 24 months or more.

Moreover, citizens eligible for deferment of conscription, if reasons for deferment no longer exist, will be conscripted.

Citizens eligible for deferment or exemption from conscription, if volunteers, will be considered for recruitment and conscription.

Vietnam: When may enlisted solders take leave according to policies in 2024?

According to Clause 1, Article 50 of the Law on Military Service 2015:

Regimes and policies for non-commissioned officers and soldiers serving active duty, being discharged, and their family members

1. For non-commissioned officers and soldiers serving active duty:

a) Ensure that they are promptly supplied with adequate and high-quality food, clothing, medicine for disease prevention and treatment; provided accommodation, monthly allowances, necessities, and cultural and spiritual needs appropriate to military tasks; ensured policies on holidays and New Year's; provided health care when injured or ill, or in accidents according to legal provisions;

b) From the thirteenth month onwards, they are entitled to leave according to policies; other cases of leave due to unforeseen reasons are regulated by the Minister of National Defense;

c) From the twenty-fifth month onwards, they receive an additional 250% of their current rank allowances monthly;

d) They are considered a family member when the family is assigned or adjusted housing or agricultural land;

dd) The period of active duty service is counted as working time;

e) They receive postal benefits;

g) Having achievements in combat, work, or training is rewarded according to legal provisions;

h) In case of injury or illness during duty, they are entitled to preferential policies according to legal provisions;

i) They are ensured social insurance and health insurance benefits according to the Law on Social Insurance and the Law on Health Insurance;

k) They are entitled to defer and are not charged interest on loans from the Social Policy Bank if they were members of poor households or students before conscription, as stipulated by law;

l) They are prioritized in military recruitment.

Thus, based on the above regulations, military service personnel from the thirteenth month onwards are entitled to leave according to policies. Leave due to unforeseen reasons is regulated by the Minister of National Defense.
