Who is entitled to enjoy an occupational allowance of 100% in public health facilities in Vietnam?
The government recently issued Decree 05/2023/ND-CP on February 15, 2023, amending and supplementing a number of articles of Decree 56/2011/ND-CP dated July 4, 2011, providing career-specific incentives to civil servants and public employees working in public health facilities.
Accordingly, in Clause 7, Article 3 of Decree 56/2011/ND-CP (added by Article 1 of Decree 05/2023/ND-CP), there are provisions:
Preferential allowances for prophylactic medicine workers and medical workers at the grassroots level were applied from January 1, 2022, to the end of December 31, 2023:
The allowance rate of 100% applies to regular employees who directly practice prophylactic medicine (including border medical quarantine); do medical professionals at health stations of communes, wards, and townships; regional polyclinics; maternity homes; medical centers of districts, urban districts, towns, provincial cities, and cities under affiliated cities; and hospitals at the district, district, town, provincial city, and city level under the central government.
Thus, compared with the allowance level in Decree 56/2011/ND-CP, the new regulation has added a 100% allowance level for officials performing the above tasks.
At the same time, Decree 05/2023/ND-CP also clearly states that, from January 1, 2024, the preferential allowances by profession for prophylactic medicine workers and grassroots health workers will be according to the provisions of Clauses 1 to 6 and Article 3 of Decree 56/2011/ND-CP or the Decree amending, supplementing, or replacing (if any).

Pursuant to Clause 1 and Article 3 of Resolution 69/2022/QH15, which stipulate as follows:
Regarding the implementation of the salary policy
1. The overall reform of the salary policy has not yet been implemented according to Resolution No. 27-NQ/TW dated May 21, 2018 of the Seventh Conference of the 12th Central Committee in 2023. From July 1, 2023, increase the base salary for cadres, civil servants, and public employees to 1.8 million VND/month; increase pensions and social insurance allowances by 12.5% for subjects guaranteed by the state budget; provide additional support for those who retired before 1995 with low benefits; increase the standard of allowance for people with meritorious services to ensure it is not lower than the standard of poor households in urban areas; and increase 20.8% of spending on social security policies that are attached to the base salary. From January 1, 2023, make adjustments to increase occupational allowances for prophylactic medicine and grassroots health workers according to Conclusion No. 25-KL/TW dated December 30, 2021 of the Politburo.
However, in Article 1 of Decree 05/2023/ND-CP, the time for applying the new allowance is from January 1, 2022, to the end of December 31, 2023.
Thus, although Decree 05/2023/ND-CP was issued on February 15, 2023, the new allowance for preventive and grassroots health workers will still be effective as of January 1, 2022.
How to calculate the occupational allowance for prophylactic medicine workers and medical workers at the grassroots level in Vietnam?
Pursuant to Clause 1 and Article 5 of Joint Circular 02/2012/TTLT-BYT-BNV-BTC, the level of preferential allowances by profession for civil servants and public employees at public health facilities is calculated as follows:
The level of preferential allowance by profession is calculated on the basis of the salary by grade, the current enjoying rank plus the allowance for leading positions, and the allowance for seniority beyond the bracket (if any). This is determined by the following formula:
Preferential allowance according to occupations = General minimum salary x Salary coefficient of current rank and rank + coefficient of allowance for leadership positions (if any) + % (according to coefficients) of seniority allowance exceeding the bracket (if any) x Preferential allowances according to the occupations to be enjoyed
- Preferential allowances by profession are calculated and paid in the same monthly salary period.
- Preferential allowances based on occupation are not used to calculate pay and benefit from social and health insurance regimes.
The Decree 05/2023/ND-CP takes effect on February 15, 2023.
