What are the principles of the Mobile Police Force?
Based on Article 4 of the Mobile Police Law 2022 stipulating the principles of operation of the Mobile Police Force as follows:
- Under the absolute, direct leadership over all aspects of the Communist Party of Vietnam, the command of the President, the unified state management of the Government of Vietnam, and the direct command, management of the Minister of Public Security.
- Comply with the Constitution, laws of Vietnam, and international treaties of which the Socialist Republic of Vietnam is a member.
- Rely on the People, promote the strength of the People, and be supervised by the People; protect the interests of the State, the rights and legitimate interests of agencies, organizations, and individuals as prescribed by law.
- Closely combine armed measures with other working measures of the People's Police force in performing assigned functions and tasks.
- Ensure centralized, unified command from central to local levels.
What behaviors are prohibited for the Mobile Police Force?
Based on Article 8 of the Mobile Police Law 2022 stipulating the prohibited behaviors for the Mobile Police Force:
- Opposing, obstructing the operation of the Mobile Police Force;
- Retaliation, threats, infringement on the life, health, honor, dignity of officers, soldiers of the Mobile Police Force, agencies, organizations, individuals participating in coordination, collaboration, support, assistance to the Mobile Police Force in carrying out public duties or for public reasons.
- Appropriating, destroying, intentionally damaging, storing, producing, trading, using illegal weapons, explosives, support tools, means, professional technical equipment of the Mobile Police Force.
- Bribing, blackmailing, or coercing officers, soldiers of the Mobile Police Force to act against assigned duties and powers.
- Impersonating officers, soldiers of the Mobile Police Force; forging means, faking, trading, using illegally uniforms, badges, seals, special work certificates of the Mobile Police Force.
- Officers, soldiers of the Mobile Police Force abusing, misusing positions, powers, work positions to violate the law, infringe the rights and legitimate interests of agencies, organizations, individuals, or having acts of harassment, causing difficulties for agencies, organizations, individuals.
What are the duties of the Mobile Police Force?
Based on Article 9 of the Mobile Police Law 2022 stipulating the duties of the Mobile Police Force as follows:
Advise the Minister of Public Security on armed measures to protect national security, ensure social order and safety; build a revolutionary, regular, elite, and modern Mobile Police Force.
- Use armed measures mainly to combat riotous, terrorist acts.
- Use armed measures and other working measures to perform the following tasks:
- Attack, prevent subjects from committing hostage-taking acts, using violence to infringe, threaten to infringe on life, health, property of individuals, organizations;
- Disperse mass gatherings causing public disorder;
- Protect events, important political, economic, diplomatic, scientific - technical, cultural, social targets and ensure the transport of special goods;
- Patrol, control to ensure security, order.
- Develop, rehearse plans to perform the tasks specified in Clause 2 Article 9 of the Mobile Police Law 2022 and Clause 3 Article 9 of this Mobile Police Law.
- Train, foster order regulations, military, martial arts, techniques, tactics for officers, soldiers of the Mobile Police Force and officers, soldiers, students in the People's Police; organize and coordinate the training of anti-terrorism work for specialized forces and forces mobilized to participate in anti-terrorism; participate in professional training to protect forces belonging to Ministries, sectors, localities as prescribed by law.
- Manage, train, and utilize duty animals to protect national security, ensure social order and safety.
- Perform ceremonies in the People's Police and important events as prescribed.
- Coordinate, support forces in the People's Police and agencies, organizations, units, other forces in protecting national security, ensuring social order and safety, combating crimes; preventing and overcoming disasters, natural disasters, epidemics;
- Search, rescue, salvage;
- Build the movement of all people to protect national security.
- Perform other tasks as prescribed by the Law on People's Police and related legal provisions.
The Mobile Police Law 2022 will take effect on January 01, 2023.
