3. Employees working overtime at night are entitled to, in addition to the pay stipulated in clauses 1 and 2 of this Article, an extra 20% of the wage calculated based on the wage unit price or the actual wage for a daytime working day of a regular working day, a weekly day off, or a public holiday.

Additionally, employees who work at night are entitled to an additional wage of at least 30% of the regular working day wage and 20% for the holiday wage.
Therefore, working on public holidays and festive days will be paid as follows:
- Working during the daytime: At least 400% of the wage.- Working during the nighttime: At least 490% of the wage.
Moreover, according to point i, clause 1, Article 3 of Circular 111/2013/TT-BTC, (https://lawnet.vn/vb/Thong-tu-111-2013-TT-BTC-Huong-dan-Luat-thue-thu-nhap-ca-nhan-va-Nghi-dinh-65-2013-ND-CP-3222C.html) which provides as follows:
Exempt Income
...
i) Income from wages and compensation for night work or overtime is exempt from tax. Specifically:
i.1) The part of wages or compensation for night work or overtime exempt from tax is calculated by subtracting the wages or compensation for regular working hours from the actual wage or compensation earned due to night work or overtime.
Example 2: Mr. A has a regular working hour wage of VND 40,000/hour.
- In case of working overtime on weekdays, Mr. A is paid VND 60,000/hour, the tax-exempt income is:
60,000 VND/hour – 40,000 VND/hour = 20,000 VND/hour
- In case of working overtime on public holidays, Mr. A is paid VND 80,000/hour, the tax-exempt income is:
80,000 VND/hour – 40,000 VND/hour = 40,000 VND/hour
...
Thus, according to the regulations mentioned above, the additional wages or compensation for night work or overtime is exempt from tax based on the actual wage or compensation for night work or overtime minus the regular working hour wage or compensation.
Therefore, according to the above regulations, the income from working on public holidays, festive days, or paid leave is taxed only on the part equal to the regular working day wage, while the additional part is tax-exempt.
