Homemakers to Benefit from Maternity Policies from July 1, 2025

On June 29, 2024, the National Assembly promulgated the 2024 Law on Social Insurance 2024 Law on Social Insurance, which includes 10 Chapters and 136 Articles.

Article 4 of the 2024 Law on Social Insurance stipulates the types and benefits of social insurance as follows:

Types and Benefits of Social Insurance

1. Social retirement allowance includes the following policies:

a) Monthly social retirement allowance;

b) Funeral expense support;

c) Health insurance covered by the state budget.

2. Mandatory social insurance includes the following policies:

a) Sickness;

b) Maternity;

c) Retirement;

d) Survivorship;

e) Occupational accident and occupational disease insurance as prescribed by the Law on Occupational Safety and Hygiene.

3. Voluntary social insurance includes the following policies:

a) Maternity allowance;

b) Retirement;

c) Survivorship;

d) Occupational accident insurance as prescribed by the Law on Occupational Safety and Hygiene.

4. Unemployment insurance as prescribed by the Employment Law.

5. Supplemental retirement insurance.

The 4 policies of voluntary social insurance include:

(1) Maternity allowance;

(2) Retirement;

(3) Survivorship;

(4) Occupational accident insurance as prescribed by the Law on Occupational Safety and Hygiene.

In Clause 2, Article 4 of the 2014 Law on Social Insurance, it is stated that individuals with 2 policies of voluntary social insurance include:

(1) Retirement;

(2) Survivorship.

Homemakers who are not subject to mandatory social insurance but participate in voluntary social insurance will benefit from maternity policies starting from July 1, 2025.

Article 95 of the 2024 Law on Social Insurancehttps://thuvienphapluat.vn/van-ban/Bao-hiem/Luat-Bao-hiem-xa-hoi-2024-557190.aspx?anchor=dieu_95 also stipulates the benefits of maternity allowance for those participating in voluntary social insurance as follows:

Maternity Allowance

1. The maternity allowance is 2,000,000 VND for each child born and for each fetus of 22 weeks or more that dies in the womb, or dies during labor.

Female ethnic minority laborers or female Kinh ethnic laborers with ethnic minority husbands belonging to poor households, when giving birth, are entitled to other supportive policies as prescribed by the Government of Vietnam.

2. The state budget ensures the implementation of the provision in Clause 1 of this Article. The Government of Vietnam will decide on adjustments to the maternity allowance in accordance with the socio-economic development conditions and state budget capacity for each period.

The maternity allowance for those participating in voluntary social insurance from July 1, 2025 is as follows:

- The maternity allowance is 2,000,000 VND for:

+ Each child born

+ Each fetus of 22 weeks or more that dies in the womb, or dies during labor.

- Female ethnic minority laborers or female Kinh ethnic laborers with ethnic minority husbands belonging to poor households, when giving birth, will receive additional support policies as prescribed by the Government of Vietnam.

* Note: The condition for maternity allowance is having a period of voluntary social insurance contributions or a combination of mandatory and voluntary social insurance contributions for at least 6 months within 12 months before childbirth (Clause 1 Article 94 of the 2024 Law on Social Insurance).

Application Procedures for Maternity Allowance from July 1, 2025

Article 96 of the 2024 Law on Social Insurance specifies the application for maternity allowance when participating in voluntary social insurance as one of the following documents:

(1) A copy of the birth certificate or birth extract or a copy of the child's birth certificate;

(2) In case of fetal death in the womb, death during labor or death after birth but no birth certificate has been issued, the dossier consists of one of the following documents:

- The original or copy of the summary of medical records indicating the child's death;- The original or copy of the hospital discharge certificate of the female laborer showing the child's death;- A copy of the child's death certificate;- A confirmation document from the commune-level People's Committee in case the child dies within 24 hours after birth.

Article 97 of the 2024 Law on Social Insurance stipulates the resolution of maternity allowance as follows:

- Within 60 days from the date of childbirth, the laborer must submit the dossier prescribed in Article 96 of the 2024 Law on Social Insurance to the social insurance agency.

- Within 5 working days from the date of receiving the complete dossier as prescribed, the social insurance agency is responsible for resolution; if not resolved, a written explanation must be provided clearly stating the reasons.

The 2024 Law on Social Insurance will come into effect on July 1, 2025.
