Current Regulations on the Salary Levels of Service Employees in State Agencies
What are the tasks performed under contracts in state agencies and state public service providers?
Based on Article 4 of Decree 111/2022/ND-CP regulating the tasks performed under contracts in state agencies and state public service providers.
Tasks performed under contracts
1. Support and service tasks in administrative agencies and public service providers that manage and apply policies as governed by labor laws, civil laws, and other relevant legal regulations, include:
a) Driving, security, except as stipulated in Clause 2 of this Article;
b) Reception, service; housekeeping; vehicle guard; maintenance, operations of headquarters, equipment, and machinery serving the operations of agencies, organizations, units;
c) Other support and service tasks that fall under the category of job positions for support and service in administrative agencies and public service providers, and are not identified as officials and public employees as per legal regulations.
2. Support and service tasks in administrative agencies that manage and apply policies like officials, include:
a) Security at agencies, units: Central Office of the Communist Party, Office of the President, Office of the National Assembly, Office of the Government of Vietnam; cash stores or stores for documents of equivalent value to money of the State Bank, State Treasury, tax seals, customs seals;
b) Driving services for Ministers or positions equivalent to Ministers and higher; specialized drivers transporting cash for the State Bank, State Treasury;
c) Other support and service personnel working in crucial, confidential central agencies as decided by the head of the competent management agency.
3. Specialized and professional tasks fall under the job positions for specialized occupational titles and general professional occupational titles in public service providers.
Thus, the tasks performed under contracts in state agencies and state public service providers are regulated as follows:
- Support and service tasks in administrative agencies and public service providers that manage and apply policies as governed by labor laws, civil laws, and other relevant legal regulations, include:
+ Driving, security
+ Reception, service; housekeeping; vehicle guard; maintenance, operations of headquarters, equipment, and machinery serving the operations of agencies, organizations, units;
+ Other support and service tasks that fall under the category of job positions for support and service in administrative agencies and public service providers, and are not identified as officials and public employees as per legal regulations.

What conditions must be met to sign contracts in state agencies and state public service providers?
Based on Clause 2 Article 5 of Decree 111/2022/ND-CP, the conditions for signing contracts are stipulated as follows:
- For administrative agencies, public service providers:
+ Must have a need to sign contracts to perform tasks as stipulated.
+ Fulfill all other requirements as per legal regulations;
- For service providing organizations:
+ Must meet all operational conditions as specified by law.
+ Ensure policies for employees as regulated by labor law and other relevant legal provisions;
- For individuals:
+ Must meet all standards and conditions required for individuals signing labor contracts for support and service tasks or for specialized and professional tasks as stipulated in this Decree.
Tasks eligible for contract signing must be documented in writing;
In cases where contracts are concluded electronically in the form of data messages as regulated by electronic transaction law, they have the same value as written contracts.
The types of contracts that can be signed include:
- Service contracts governed by civil law and other relevant legal regulations;
- Labor contracts as governed by labor law and as specified in this Decree.
