Health Insurance Contribution Rates Under the Management of the Ministry of National Defense in 2023: Regulations and Provisions

Who are the participants in health insurance under the management of the Ministry of National Defense?

Pursuant to Article 1 of Circular 143/2020/TT-BQP regarding participants in health insurance under the management scope of the Ministry of National Defense as follows:

- Participants in health insurance under the management scope of the Ministry of National Defense, cipher organizations, and relatives of active-duty soldiers, relatives of cipher workers, and those working in other roles at the Government's Cipher Committee, relatives of defense workers, and public employees stipulated in Clause 1 Article 1; Clauses 13 and 15 Article 3; Clause 3 Article 4 and Clauses 1 and 3 Article 6 of Decree 146/2018/ND-CP of the Government of Vietnam, which elaborates and guides the implementation of certain provisions of the Law on Health Insurance (hereinafter abbreviated as Decree 146/2018/ND-CP), include:

* Group contributed by workers and employers for health insurance

- Civil servants, defense workers, public employees.- Workers employed under indefinite-term labor contracts or labor contracts with a term of 03 months or more in agencies or units under the Ministry of National Defense.- Workers in other roles at the Government's Cipher Committee.- Young volunteer intellectuals following Decision 174/QD-TTg in 2010 of the Prime Minister on approving the project to "Enhance young volunteer intellectuals to work at defense economic zones from 2010 to 2020."

* Group paid by the state budget for health insurance

- Students of national defense and security pursuant to Decision 607/QD-TTg in 2014 of the Prime Minister approving the Scheme for training teachers and lecturers in national defense and security for various educational institutions until 2020; students training military officers for the Commune Military Command (full-time system) pursuant to Decision 799/QD-TTg in 2011 of the Prime Minister approving the Scheme for training military officers for Commune Military Command at college and university levels in the foundation of military from 2020 and onwards, who receive living expenses from the state budget and have not yet participated in health insurance.- International military students studying at academies, educational institutions, and training centers under the Ministry of National Defense pursuant to international treaties or agreements, or invited and sponsored by the State.- Relatives of officers, professional soldiers, non-commissioned officers, enlisted soldiers on active duty, including those with a decision to be trained as reserve officers (hereinafter collectively referred to as relatives of soldiers), including those specified in Points a, b, and c Clause 13 Article 3 of Decree 146/2018/ND-CP.- Relatives of cipher workers who receive salaries equivalent to soldiers working in the Ministry of National Defense; relatives of cipher students eligible for policies similar to those for students of military schools, including those specified in Points a, b, and c Clause 13 Article 3 of Decree 146/2018/ND-CP.

* Group partially subsidized by the state budget:

Students in civilian academic programs within military academies and schools, and at the Cipher Committee.

* Group with health insurance contributed by employers:

- Relatives of defense workers and public employees serving in the Army, including those specified in Points a, b, and c Clause 13 Article 3 of Decree 146/2018/ND-CP.- Relatives of persons specified in Point c Clause 1 Article 1 of Circular 143/2020/TT-BQP including those specified in Point a Clause 4 Article 1 of Circular 143/2020/TT-BQP.

How are the health insurance contributions under the management of the Ministry of National Defense regulated?

According to Article 3 of Circular 143/2020/TT-BQP, the contributions and responsibilities for health insurance contributions under the management of the Ministry of National Defense are as follows:

* For the participants specified in Clause 1 Article 1 of Circular 143/2020/TT-BQP:

- The monthly contribution rate is 4.5% of the monthly salary according to rank, grade, and various allowances such as position allowance, seniority allowance beyond the frame, and professional seniority allowance (for workers applying salary policies prescribed by the State), or 4.5% of the monthly salary stated in the labor contract (for workers paid according to employer-determined wages or salaries); of which, the employer contributes 2/3, and the employee contributes 1/3.- During the period when the worker is detained, held, or temporarily suspended from work for investigation, the monthly contribution rate is 4.5% of 50% of the worker's monthly salary as prescribed by law.In the event that the competent authority concludes no violation of the law, the worker must retroactively pay health insurance on the retroactive salary received.- During the period the worker is sent to study, work, or labor abroad, they are exempted from health insurance contributions; this period is considered as the participation in health insurance until the decision to return to work by the sending agency or organization; within 30 days from the date of re-entry into the country, if participating in health insurance, the entire period of studying, working, or laboring abroad and the period from returning to the country until joining health insurance is considered continuous participation in health insurance.- Workers who are on sick leave for 14 days or more in a month according to the law on social insurance contributions are exempted from health insurance contributions, but still enjoy health insurance benefits.

* For the participants specified in Clause 2 Article 1 of Circular 143/2020/TT-BQP:

The monthly contribution rate is 4.5% of the statutory pay rate and is funded by the state budget.

* For the participants specified in Clause 3 Article 1 of Circular 143/2020/TT-BQP:

The monthly contribution rate is 4.5% of the statutory pay rate.

* For the participants specified in Clause 4 Article 1 of Circular 143/2020/TT-BQP:

The monthly contribution rate is 4.5% of the statutory pay rate. For units using the state budget, it is financed by the state budget; for public service providers, it is funded from the unit's budget according to the laws on the self-financing mechanism of public service providers; for enterprises, it is funded by the enterprise.

What is the current statutory pay rate?

Based on Decree 24/2023/ND-CP stipulating as follows:

Statutory pay rate

1. The statutory pay rate is used as a basis for:

a) Calculating the salary levels in salary tables, allowances, and implementing other policies according to the law for those specified in Article 2 of this Decree;

b) Calculating operational and living expenses according to the law;

c) Calculating deductions and policies enjoyed based on the statutory pay rate.

2. From July 01, 2023, the statutory pay rate is 1,800,000 VND/month.

The statutory pay rate used as a basis for health insurance contributions under the management of the Ministry of National Defense is currently 1,800,000 VND.
