On May 10, 2024, the Government of Vietnam issued Decree 50/2024/ND-CP amending and supplementing certain articles of Decree 136/2020/ND-CP detailing certain provisions and implementing measures of the Law on Fire Prevention and Fighting 2001 and the Law amending and supplementing certain articles of the Law on Fire Prevention and Fighting, and Decree 83/2017/ND-CP.
In Appendix IX issued with Decree 50/2024/ND-CP, regulations on the license form to transport goods posing fire and explosion hazards apply from May 15, 2024, as follows:

What documents are included in the application for a license to transport goods posing fire and explosion hazards by rail in Vietnam from May 15, 2024?
According to the provisions of Clause 2, Article 9 of Decree 136/2020/ND-CP as amended by Point a, Clause 1, Article 5 of Decree 50/2024/ND-CP, the application for a license to transport goods posing fire and explosion hazards by rail includes the following documents:
Article 9. Licensing for the transport of goods posing fire and explosion hazards

2. The application for a license to transport goods posing fire and explosion hazards by rail:
a) A written request for a license to transport goods posing fire and explosion hazards (Form No. PC02);
...
c) A list detailing the category, quantity, and transport route of goods posing fire and explosion hazards (departure station, arrival station); a list of persons escorting the hazardous goods;
d) A copy certified by the enterprise of the transport contract or written agreement on the transportation of goods posing fire and explosion hazards by rail between the shipper of the hazardous goods and the rail transport enterprise;
dd) Plans for prevention and response to incidents during the transportation of goods posing fire and explosion hazards with signatures and seals of the organization or individual requesting the transportation license;
e) Plans for cleaning the vehicles and ensuring environmental protection requirements after completing the transport as stipulated by current regulations on environmental protection.
Thus, the application for a license to transport goods posing fire and explosion hazards by rail includes:
- A written request for a license to transport goods posing fire and explosion hazards (Form No. PC02 issued with Decree 50/2024/ND-CP);
- A list detailing the category, quantity, and transport route of goods posing fire and explosion hazards (departure station, arrival station); a list of persons escorting the hazardous goods;

Who is authorized to issue a license to transport goods posing fire and explosion hazards by rail in Vietnam?
In Clause 8, Article 9 of Decree 136/2020/ND-CP, the authorization for licensing the transport of goods posing fire and explosion hazards is stipulated as follows:
Licensing for the transport of goods posing fire and explosion hazards
...
8. Authorization for licensing the transport of goods posing fire and explosion hazards by road, inland waterway, and rail:
a) The Provincial Police Department's Fire Prevention and Rescue Police Department grants licenses for the transportation of goods posing fire and explosion hazards to vehicles of agencies, organizations, and individuals that have their headquarters or operate vehicles in the assigned and decentralized management area for fire prevention and fighting;
b) The District Police Department grants licenses for the transportation of goods posing fire and explosion hazards to vehicles of agencies, organizations, and individuals that have their headquarters or operate vehicles in the management area not under the authority of the Provincial Police Department's Fire Prevention and Rescue Police Department and those cases authorized by the Provincial Police Department's Fire Prevention and Rescue Police Department.
According to the above regulation, the authority to issue a license to transport goods posing fire and explosion hazards by rail depends on the type of vehicle and different areas, with each authority having the power to issue the transportation license for hazardous goods.
