Based on Appendix IV attached to Decree 34/2024/ND-CP dated March 31, 2024, of the Government of Vietnam, the format of the application for issuing a dangerous goods transport license in Vietnam is as follows:

Which authority has the competent to issue the dangerous goods transport licenses? What is the validity of the license?
Based on Article 17 of Decree 34/2024/ND-CP, the authority to issue the license is as follows:
Authority to Issue the license and Cases for Exemption from Issuing the dangerous goods transport licenses in Vietnam
1. The Ministry of Public Security organizes the issuance of licenses for transporting dangerous goods of types 1, 2, 3, 4, and 9 according to the provisions of Clause 1, Article 4 of this Decree (excluding pesticides and as stipulated in Clause 2 of this Article).
2. The Ministry of National Defense organizes the issuance of licenses for transporting dangerous goods to organizations and enterprises under the management of the Ministry of National Defense.
3. The Ministry of Science and Technology organizes the issuance of licenses for transporting dangerous goods of types 5 and 8 according to the provisions of Clause 1, Article 4 of this Decree.
4. The People's Committees of provinces and centrally-run cities organize the issuance of licenses for transporting dangerous goods that are pesticides.
5. The authority issuing licenses for transporting dangerous goods bases its decisions on the type and group of dangerous goods according to the provisions of Clause 1, Article 4 of this Decree to decide the transport route and time.
6. The issuance of licenses for transporting dangerous goods of type 7 is carried out in accordance with the Decree on the conduct of radiation work and supporting activities for the application of nuclear energy.
7. The authority issuing licenses for transporting dangerous goods may refuse to issue licenses for the transport of flammable and explosive substances, which pass through tunnel or ferry constructions as stipulated in Article 12 of this Decree.
The licenses for transporting dangerous goods are issued by the competent Ministries. Furthermore, the People's Committees of provinces and centrally-run cities organize the issuance of licenses for transporting dangerous goods that are pesticides.
Additionally, based on Clause 3, Article 16 of Decree 34/2024/ND-CP, the validity of the dangerous goods transport license is specified as follows:

3. The dangerous goods transport license is valid nationwide. The validity period of the license is based on the request of the transporter but must not exceed 24 months and must not exceed the service life of the vehicle.

How are the procedures for issuing a dangerous goods transport license in Vietnam carried out?
Based on Clause 1, Article 19 of Decree 34/2024/ND-CP, the procedures for issuing a dangerous goods transport license in Vietnam are specified as follows:
- Step 1: Submission of Application
The dangerous goods transporter submits 01 set of application documents requesting the issuance of a dangerous goods transport license according to the provisions of Clauses 1, 2, and 3 of Article 18 of Decree 34/2024/ND-CP to the authority issuing the dangerous goods transport license.
+ In the case of direct submission: The administrative procedure solving agency checks the composition of the Application and responds immediately when the organization or individual submits the application; if the Application is incomplete or has discrepancies, they guide the completion of the Application as prescribed.
+ In the case of submission via postal service or online public service system: Within 01 working day from the date of receipt of the Application, the administrative procedure solving agency must review the completeness of the Application. If incomplete, the administrative procedure solving agency must notify in writing or through the online public service system to the organization or individual for supplementation and guide them to complete the Application as prescribed.
Note: The procedure for issuing licenses for transporting dangerous goods of type 7 is carried out according to the regulations on the conduct of radiation work and supporting activities for the application of nuclear energy.
- Step 2: Application Processing
Within 05 working days from the date of receipt of a complete and proper Application, the authority issuing the license must appraise the Application and issue the dangerous goods transport license.
If the license is not issued, the authority must respond in writing or notify through the online public service system, stating the reason.
Decree 34/2024/ND-CP comes into force in Vietnam from May 15, 2024.
