Lunar New Year Holiday 2024: From What Day and Date on the Gregorian Calendar?

On November 22, the Ministry of Labor, War Invalids and Social Affairs issued Notice 5015/TB-LDTBXH of 2023 regarding the Lunar New Year and National Day holidays in 2024 for officials, public employees, and workers.

The Lunar New Year holiday schedule for 2024 for officials, public employees, and workers in administrative agencies, public service agencies, political organizations, and socio-political organizations (hereinafter referred to as officials and public employees) is as follows:

- Officials and public employees and workers in administrative agencies, public service agencies, political organizations, and socio-political organizations (hereinafter referred to as officials and public employees) will have a Lunar New Year holiday in 2024 from Thursday, February 8, 2024, on the Gregorian calendar (i.e., the 29th day of the 12th lunar month of the Year of the Rabbit) until the end of Wednesday, February 14, 2024, on the Gregorian calendar (i.e., the 5th day of the 1st lunar month of the Year of the Dragon). This holiday includes 5 Lunar New Year holiday days and 2 additional compensatory days according to Clause 3, Article 111 of the Labor Code.

Thus, officials and public employees will start their Lunar New Year holiday in 2024 from Thursday, February 8, 2024, on the Gregorian calendar until the end of Wednesday, February 14, 2024, on the Gregorian calendar.

For workers in enterprises, the Ministry of Labor, War Invalids and Social Affairs stated that based on actual conditions and the holiday schedule for officials and public employees, employers should arrange the Lunar New Year holiday schedule for their employees as follows (it is recommended that employers apply the same holiday schedule as for officials and public employees):

- Lunar New Year holiday in 2024:

+ Choose 1 day before the New Year and 4 days after the New Year or 2 days before the New Year and 3 days after the New Year or 3 days before the New Year and 2 days after the New Year.

+ Notify employees about the Lunar New Year holiday plan at least 30 days before implementation.

The Lunar New Year 2024 falls on a Saturday and Sunday of the week, thereby the Lunar New Year 2024 holiday for workers will be as follows:

*For employees not required to work on Saturdays of the week:

- For companies choosing the option of 1 day before the New Year and 4 days after the New Year:

Workers will start their Lunar New Year holiday in 2024 from Friday, February 9, 2024 (i.e., the 30th day of the 12th lunar month of the Year of the Rabbit) until the end of Thursday, February 15, 2024 (the 6th day of the 1st lunar month).

- For companies choosing the option of 2 days before the New Year and 3 days after the New Year:

Workers will start their Lunar New Year holiday in 2024 from Thursday, February 8, 2024 (i.e., the 29th day of the 12th lunar month of the Year of the Rabbit) until the end of Wednesday, February 14, 2024 (the 5th day of the 1st lunar month).

- For companies choosing the option of 3 days before the New Year and 2 days after the New Year:

Workers will start their Lunar New Year holiday in 2024 from Wednesday, February 7, 2024 (i.e., the 28th day of the 12th lunar month of the Year of the Rabbit) until the end of Tuesday, February 13, 2024 (the 4th day of the 1st lunar month).

Thus, workers will have a continuous 7-day holiday, which includes 5 Lunar New Year holidays as prescribed by the State and 2 additional compensatory days (due to Saturday and Sunday being regular days off).

*For employees required to work on Saturdays of the week:

- For companies choosing the option of 1 day before the New Year and 4 days after the New Year:

Workers will start their Lunar New Year holiday in 2024 from Friday, February 9, 2024 (i.e., the 30th day of the 12th lunar month of the Year of the Rabbit) until the end of Wednesday, February 14, 2024 (the 5th day of the 1st lunar month).

- For companies choosing the option of 2 days before the New Year and 3 days after the New Year:

Workers will start their Lunar New Year holiday in 2024 from Thursday, February 8, 2024 (i.e., the 29th day of the 12th lunar month of the Year of the Rabbit) until the end of Tuesday, February 13, 2024 (the 4th day of the 1st lunar month).

- For companies choosing the option of 3 days before the New Year and 2 days after the New Year:

Workers will start their Lunar New Year holiday from Wednesday, February 7, 2024 (i.e., the 28th day of the 12th lunar month of the Year of the Rabbit) until the end of Monday, February 12, 2024 (the 3rd day of the 1st lunar month).

Workers will have a continuous 6-day holiday, which includes 5 Lunar New Year holidays as prescribed by the State and 1 additional compensatory day (due to Sunday being a regular day off).

Note: The above holiday schedules are for reference. The final determination of the Lunar New Year 2024 holiday schedule will depend on each enterprise.

Number of National and New Year Holiday Days in 2024 for Employees

The 2024 holiday schedule for employees is as follows:

(1) New Year Holiday 2024 (Point a Clause 1 Article 112 of the 2019 Labor Code)

1 day (January 1 on the Gregorian calendar)

(2) Lunar New Year Holiday 2024 (Point b Clause 1 Article 112 of the 2019 Labor Code)

Lunar New Year: 5 days

(3) April 30 and May 1 Holidays in 2024 (Points c, d Clause 1 Article 112 of the 2019 Labor Code)

1 day (April 30 on the Gregorian calendar); 1 day (May 1 on the Gregorian calendar)

(4) National Day Holiday on September 2, 2024 (Point e Clause 1 Article 112 of the 2019 Labor Code)

2 days (September 2 on the Gregorian calendar and 1 contiguous day before or after)

(5) Hung Kings' Commemoration Day Holiday in 2024 (Point f Clause 1 Article 112 of the 2019 Labor Code)

1 day (the 10th day of the 3rd lunar month).

Note: Foreign workers in Vietnam are entitled to additional holidays including 1 traditional New Year's Day and 1 National Day of their home country.

How Is the Salary Calculated for Working on New Year Holiday 2024?

According to Article 98 of the 2019 Labor Code, the overtime and night work pay is regulated as follows:

Overtime and Night Work Pay

1. Employees working overtime are entitled to at least the following pay based on the wage unit price or the actual wage for the job being performed:

a) On regular days, at least 150%;

b) On weekly days off, at least 200%;

c) On holidays, New Year holidays, and paid leave days, at least 300%, in addition to the regular holiday or leave day's pay for employees paid on a daily wage basis.

2. Employees working at night are entitled to an additional at least 30% of the wage calculated based on the wage unit price or the actual wage for the job being performed during the daytime.

3. Employees working overtime at night are, in addition to the pay stipulated in Clauses 1 and 2 of this Article, entitled to an additional 20% of the wage calculated based on the wage unit price or the wage for the job performed during the daytime of a normal working day or a weekly day off, or a holiday or Tet day.

4. The Government of Vietnam specifies this Article further.

Thus, according to the above regulations, employees working on the New Year holidays in 2024 will receive their salary as follows:

- At least 300%, not including the holiday or New Year day's pay for employees paid on a daily wage basis.

In case of working at night, the employee will further receive an additional at least 30% of the wage calculated based on the wage unit price or the actual wage for the job being performed during the daytime and an additional 20% of the wage calculated based on the wage unit price or the wage for the job performed during the daytime of a holiday or Tet day.
