According to Article 69 of the Land Law 2024, the responsibilities for organization of development of land use planning and plans in Vietnam are as follows:

- The Government of Vietnam organizes the development of national land use planning and plans.

The Ministry of Natural Resources and Environment is responsible for leading the assistance to the Government of Vietnam in the development of national land use planning and plans.

- The Provincial People's Committees organize the development of provincial land use planning and plans.

The provincial land management agency is responsible for leading the assistance to the Provincial People's Committees in the development of provincial land use planning and plans.

- The District People's Committees organize the development of district land use planning and annual district land use plans.

The district land management agency is responsible for leading the assistance to the District People's Committees in the development of district land use planning and annual district land use plans.

- Land use planning is approved in the first year of the planning period.

- Land use planning and plans for coastal localities include the reclaimed land areas.

According to Article 65 of the Land Law 2024:

Provincial land use planning

1. The basis for developing provincial land use planning includes:

a) National land use planning and plans;

b) National sectoral, regional plans; technical and specialized plans using national and inter-provincial land;

c) Provincial planning;

d) Natural, economic, and social conditions of the provincial administrative unit;

dd) Current land use status, land changes, land quality, land potential, and the results of the previous planning period implementation of the province;

e) Needs and capabilities of land use for industries, sectors, localities; public investment resources, and other resources;

g) Scientific and technological advancements related to land use.

2. The content of provincial land use planning includes:

a) Land use orientation identified in the provincial planning, with a vision to meet economic, social development requirements; ensuring national defense and security; environmental protection, and climate change adaptation;

b) Determining the land use criteria allocated in the national land use planning, and land use criteria according to provincial land use needs;

c) Assigning land use criteria specified at point b of this clause to each district-level administrative unit;

d) Identifying the boundaries, locations, and areas of the reclaimed land for agricultural and non-agricultural purposes;

dd) Delineating areas of land to be strictly managed, including: rice cultivation land, special-use forest land, protection forest land, production forest land as natural forests;

e) Phasing the land use planning for each 5-year plan according to the contents specified at points b, c, d, and đ of this clause;

g) Solutions and resources to implement land use planning.

What are regulations on planning for use of national defense land and planning for use of security land in Vietnam?

According to Article 68 of the Land Law 2024, the regulations for Planning for use of national defense land and planning for use of security land are as follows:

- Planning for use of national defense land and planning for use of security land are national sectoral plans.

- The basis for developing Planning for use of national defense land and planning for use of security land includes legal bases as prescribed by planning law and the following bases:

+ National general planning, national marine spatial planning, national land use planning;

+ Natural, economic, and social conditions of the country;

+ Current land use status and the results of the previous Planning for use of national defense land and planning for use of security land period;

+ Needs and capabilities of defense and security land use.

- The content of Planning for use of national defense land and planning for use of security land is implemented according to the provisions of planning law.

- The Ministry of Defense and the Ministry of Public Security lead and cooperate with the Provincial People's Committees during the development of Planning for use of national defense land and planning for use of security land to ensure compliance with the economic, social development requirements, national defense, and security; review, determine the locations, areas, and boundaries of land used for defense and security purposes; determine the locations, areas, and boundaries of defense and security land that are no longer needed for transfer to local management and use.
