How much advance salary can employees receive for Tet holidays in Vietnam?
Based on the provisions of Article 101 of the 2019 Labor Code regarding salary advances, the regulations are as follows:
Salary Advances
1. Employees are entitled to a salary advance according to conditions agreed upon by both parties without interest.
2. Employers must provide salary advances to employees equivalent to the number of days the employee temporarily takes leave to fulfill civic duties from 01 week or more, but not exceeding 01 month’s salary according to the labor contract, and the employee must repay the advanced amount.
Employees conscripted according to the regulations of the Law on Military Service are not entitled to a salary advance.
3. During annual leave, employees may advance an amount at least equivalent to the salary of the leave days.
Thus, according to legal regulations, there is no maximum limit specified for salary advances an employee can request.
Therefore, employees can negotiate with their employers about the specific salary advance amount.
Are enlisted soldiers allowed to take leave to return home for Tet holiday in Vietnam in 2024?
Based on the provisions of clause 1, Article 50 of the 2015 Law on Military Service concerning policies for non-commissioned officers, enlisted soldiers on active duty, discharged soldiers, and their families, the regulations are as follows:

1. For non-commissioned officers and enlisted soldiers during active duty:
a) Promptly provided with sufficient quality and quantity of food, clothing, medicines for disease prevention and treatment, accommodation, monthly allowances, essential goods, and cultural and spiritual needs appropriate to military task characteristics; policies ensured during holidays and Tet; health care provided in case of injury, illness, or accidents as per legal regulations;
b) From the thirteenth month onwards, annual leave is granted as per the policies, or for other unexpected reasons as specified by the Minister of National Defense;

Based on the provisions of clause 1, Article 3 of Decree 27/2016/ND-CP concerning leave policies for non-commissioned officers and enlisted soldiers on active duty, the regulations are as follows:

1. Non-commissioned officers and enlisted soldiers on active duty from the thirteenth month onwards are entitled to annual leave; the leave duration is 10 days (excluding travel days) and they are provided with travel expenses and per diem according to current regulations.

Thus, according to the policies for non-commissioned officers and enlisted soldiers on active duty, from the thirteenth month onwards, they are entitled to annual leave, or for other unexpected reasons as specified by the Minister of National Defense.
Accordingly, for Tet 2024, if non-commissioned officers and enlisted soldiers on active duty from the thirteenth month onwards have annual leave days, they can use them for Tet holidays.
