Pursuant to Clause 1, Article 112 of the Labor Code 2019, employees are entitled to two days off with full pay for the National Day (September 2 Gregorian calendar and one contiguous day before or after).

According to Official Dispatch 8662/VPCP-KGVX of 2023 from the Office of the Government of Vietnam, considering the proposal of the Ministry of Labor, Invalids, and Social Affairs in Official Dispatch 4594/LDGVT-ATLĐ of 2024 on the proposal of the Lunar New Year holiday and the National Day holiday schedule for September 2, 2024, the Prime Minister of the Government of Vietnam agreed with the proposal of the Ministry of Labor, Invalids, and Social Affairs in the mentioned document regarding the National Day holiday schedule for September 2, 2024, from August 31, 2024, to the end of September 3, 2024.

The Prime Minister of the Government of Vietnam assigned the Minister of Labor, Invalids, and Social Affairs to inform administrative agencies, career organizations, political organizations, social-political organizations, enterprises, and employees of the National Day holiday schedule for 2024.

According to Notification 5015/TB-LDGVT of 2023 from the Ministry of Labor, Invalids, and Social Affairs, officials and public employees will be on the National Day holiday in 2024 from Saturday, August 31, 2024, to the end of Tuesday, September 3, 2024, Gregorian calendar.

The National Day holiday in 2024 will last 4 days, including 2 days of National Day holiday and 2 weekly days off.

The Ministry of Labor, Invalids, and Social Affairs requests agencies and units to implement the National Day holiday schedule for 2024, ensuring rational assignment and arrangement of working departments to continuously resolve work and ensure good service to organizations and the public.

Agencies and units that do not follow the fixed Saturday and Sunday weekly holiday schedule will base their decision on the specific program and plan of the unit to arrange the National Day holiday schedule for 2024 appropriately.

For employees not belonging to administrative agencies, career organizations, political organizations, or social-political organizations, employers will decide on the National Day holiday schedule for 2024 as follows:

- National Day holiday: Monday, September 2, 2024, Gregorian calendar, and choose one of the two days: Sunday, September 1, 2024, or Tuesday, September 3, 2024, Gregorian calendar.

- Notify employees of the National Day holiday schedule for 2024 at least 30 days in advance before implementation.

- If a weekly day off coincides with a holiday, as specified in Clause 1, Article 112 of the Labor Code 2019, employees will be given an alternative day off, on the following working day, in accordance with Clause 3, Article 111 of the Labor Code 2019.

4. Liberation Day of Southern Vietnam, national reunification (April 30, 1975).

5. Dien Bien Phu Victory Day (May 7, 1954).

6. President Ho Chi Minh’s birthday (May 19, 1890).

7. August Revolution Day (August 19, 1945) and National Day of the Socialist Republic of Vietnam (September 2, 1945).

Thus, the National Day of the Socialist Republic of Vietnam (September 2, 1945) is one of seven major holidays as regulated by law.

How will employee work during National Day holiday in Vietnam be paid?

According to the provisions of Article 98 of the Labor Code 2019 regarding overtime and night work pay:

Overtime and Night Work Pay

1. Employees working overtime are paid according to the wage rate or actual wage they are receiving as follows:

a) On normal days, at least 150%;

b) On weekly days off, at least 200%;

c) On holidays, Tet holidays, paid days off, at least 300% not including the wage on holidays, Tet holidays, or paid days off for daily wage earners.

2. Employees working at night are paid an additional 30% of the wage calculated according to the wage rate or actual wage for the normal working day.

3. Employees working overtime at night, in addition to being paid according to provisions in Clauses 1 and 2 of this Article, are also paid an additional 20% of the wage rate or wage for day work on the normal working day or weekly day off or holiday, Tet holidays.

4. the Government of Vietnam stipulates the details of this Article.

When employees work on holidays or Tet holidays, they are paid at least 300% of their wage, not including holiday wage for daily wage earners.

Additionally, if employees work at night, they will be paid an extra 30% of the normal day's wage and 20% of the holiday wage.

Thus, if working on holidays or Tet holidays, the wage is calculated as follows:

- Daytime work: At least 400% wage.

- Night work: At least 490% wage.
