Law on Vietnam Border Defense: How Many Measures are Prescribed for National Border Management and Protection?
What are the forms of management and protection of national borders?
Based on Article 19 of the Vietnam Border Defense Law 2020, the regulations are as follows:
Forms of Management and Protection of National Borders
1. The forms of management and protection of national borders include:
a) Regular border management and protection are applied when the sovereignty, territory, security, order, and social safety situation in the border area are stable;
b) Enhanced border management and protection are applied during important political, economic, cultural, and social events happening in the border area, border gates, on both sides of the border; complex security, order, and social safety situations in some areas of the border region; when external areas or border regions are conducting military, security, order exercises, natural disasters, disasters, epidemics, rescue, or are conducting activities to chase down criminals who could cross the border; upon request from the border management and protection forces of a neighboring country with which Vietnam shares a border;
c) Border management and protection during emergencies related to national defense, martial law, curfew, and wartime situations are implemented according to national defense laws.
2. The authority to decide on the shift of the form of management and protection of national borders is stipulated as follows:
a) The Commander of the Border Guard decides on the shift of the form of border management and protection as regulated in point a and point b of clause 1 of this Article, and immediately reports to the Ministry of National Defense, and is responsible before the law for their decision;
b) The Minister of National Defense decides on the shift of the form of border management and protection as regulated in point c of clause 1 of this Article.
3. The Minister of National Defense stipulates the details of points a and b of clause 1 of this Article.
Thus, currently, the forms of management and protection of national borders are to be implemented according to the regulations stated above, including:
- Regular border management and protection- Enhanced border management and protection- Border management and protection during emergencies related to national defense, martial law, curfew, and wartime situations

How many measures for managing and protecting national borders are specified in the Vietnam Border Defense Law 2020?
Based on Article 20 of the Vietnam Border Defense Law 2020, the measures for managing and protecting national borders are as follows:

1. The measures for managing and protecting national borders include:
a) Public mobilization;
b) Legal measures;
c) Diplomatic measures;
d) Economic measures;
e) Scientific and technical measures;
f) Professional measures;
g) Armed measures.
2. The contents, conditions, authority, procedures, and responsibilities for applying the measures stated in clause 1 of this Article are regulated by law.
Thus, according to regulations, there are a total of 07 measures for managing and protecting national borders as listed above.
What are the State's policies on border defense?
Based on Article 3 of the Vietnam Border Defense Law 2020, the State's policies on border defense are as follows:
State Policies on Border Defense
1. To implement the policy of independence, sovereignty, unity, and territorial integrity; to build a peaceful, friendly, cooperative, and developing border, maintaining long-term stability with neighboring countries; to expand international cooperation, defense, security, border, and people-to-people diplomacy.
2. To resolve national border issues by peaceful means, respecting independence, sovereignty, unity, territorial integrity, and each other’s legitimate interests, in accordance with the Constitution and laws of Vietnam and international treaties to which the Socialist Republic of Vietnam is a member.
3. To use legitimate and appropriate measures to protect the independence, sovereignty, unity, and territorial integrity of the homeland.
4. To implement the policy of great national unity; to build a comprehensive, strong nationwide force for national border protection, with the people being the core and the people's armed forces being the nucleus.
5. To consolidate and enhance national defense and security; to prioritize resources investment, modernize border infrastructure, and develop economy, culture, society, science, technology, and international relations in the border areas.
6. To mobilize resources from agencies, organizations, and individuals for performing border defense duties.
7. To encourage and facilitate agencies, organizations, and individuals to support the material, financial, and spiritual performance of border defense tasks on a voluntary basis, in line with Vietnamese laws and international laws.
Thus, currently, regarding border defense, the State has the above-mentioned policies.
