Pursuant to subsection 17, Section 1, Appendix 2 issued together with Decision No. 1085/QD-BTNMT in 2023, guiding the implementation of procedures for selling and contributing capital with assets attached to land leased from the State of Vietnam in the form of land lease annual payment at the provincial agency as follows:
(1) Land users buy and sell, contribute capital with assets attached to land according to the provisions of civil law, submit dossiers at the Land Registration Office or the Branch of the Land Registration Office or the dossier-receiving agency as prescribed by the provincial-level People's Committee or the location according to demand, for the localities where the provincial-level People's Committee has promulgated regulations on receipt, rotation of dossiers, handling and return the results of the procedure according to the needs of the location.
- In case of purchase and sale, capital contribution with assets attached to a part of the leased land plot, the procedures for separating the land plot must be carried out before carrying out the procedures for land lease.
- Households, individuals and communities shall submit dossiers to the commune-level People's Committees if they wish.
- In case of receiving incomplete or invalid dossiers, within a maximum of 03 days, the dossier-receiving and processing agencies must notify and guide the dossier-submitters to supplement and complete the dossiers according to regulations.
(2) The application-receiving agency shall record all information in the application-receiving book and return the results, hand over the application-receiving slip and return the results to the applicant.
(3) The land registration office or the branch of the land registration office shall compile a dossier for the purchaser and the recipient of capital contribution with land-attached assets to continue to lease the land, and transfer to the competent natural resources and environment agency to receive the land lease dossier.
(4) The natural resources and environment agency is responsible for verifying the documents and conditions for the sale and purchase of assets attached to the leased land; if all conditions are satisfied, they shall submit it to the People's Committee of the competent level for decision on the recovery of land from the seller or the party contributing capital with properties attached to the leased land for the purchaser or the recipient to contribute capital with. attached to land continue to lease land; sign a land lease contract with the purchaser, receive capital contribution in the form of assets attached to the leased land; notify in writing the tax authority of the expiration of the land lease contract for the seller or the person contributing capital with the property;
(5) The land registration office or the branch of the land registration office shall send the land lease contract to the buyer, the recipient of capital contribution with assets attached to the leased land; to correct and update changes in cadastral records and land databases; handing over the Certificate to the grantee or sending the Certificate to the commune-level People's Committee to hand it over to the grantee in the case of households, individuals, and community communities submitting dossiers at the commune level.

- Contracts, documents on sale and purchase, capital contribution with land-attached assets in accordance with civil law.
- The original of the issued Certificate;
- Land lease contract signed with the State of Vietnam.
Which provincial-level agency has the authority to decide on procedures for selling and contributing capital with assets attached to land leased from the State of Vietnam in the form of land lease with annual payment?
Pursuant to subsection 17, Section 1, Appendix 2 issued together with Decision No. 1085/QD-BTNMT in 2023, the competent provincial-level agency shall decide to sell or contribute capital with assets attached to land leased from the State of Vietnam according to regulations. Forms of land lease with annual payment include:
- Provincial-level People's Committees in case the land users, owners of land-attached assets are organizations, overseas Vietnamese or foreign-invested enterprises implementing investment projects; foreign organizations with diplomatic functions selling assets attached to leased land.
- District-level People's Committees in case the land users or owners of land-attached assets are households or individuals selling leased land-attached assets.
- The land registration office or the branch of the land registration office shall issue or certify changes on the issued Certificate.
In addition, the agency directly implementing administrative procedures is the Land Registration Office or the Branch of Land Registration Office.
