According to Article 157 Decree 131/2021/ND-CP guiding the Ordinance on Incentives for people with meritorious services to the revolution stipulates the conditions for moving the remains of martyrs in Vietnam as follows:

- Only applies to the relocation of martyrs' remains inVietnam for the following cases of martyrs' graves:

+ Martyrs' graves with full information are being buried in martyrs' cemetery.

+ Martyrs' graves are buried outside the martyrs cemetery but there is a record of handover of martyrs' remains from a competent agency, now they are buried in the martyr's cemetery.

+ Graves of wounded soldiers who died due to recurrent wounds are recognized as martyrs, now buried in martyrs cemetery.

What are the dossiers and procedures for moving the remains of martyrs outside to be buried at the martyrs cemetery?

Pursuant to Article 160 Decree 131/2021/ND-CP guiding the Ordinance on Incentives for people with meritorious services to the revolution stipulates dossiers and procedures for moving the remains of Vietnamese martyrs who are buried outside the martyrs cemetery for burial in Vietnam. Martyrs' cemetery at the request of the representative of the relative or the beneficiary of the allowance for martyrs' worship as follows:

In the case of not being supported:

-request to move the remains of martyrs according to the provisions of Form No. 32, Appendix I of this Decree to the Department of Labor, War Invalids and Social Affairs where the original dossier is managed.

+ If the martyr's grave is handed over to the family for management by a competent agency, a certified copy of the minutes of handing over the martyr's remains must be enclosed.

+ In case the martyr's relatives authorize the movement of the martyr's remains, the authorization document must be attached.

+ The Department of Labor, War Invalids and Social Affairs, which manages the original dossier, within 3 working days after receiving the application and documents, is responsible for examining and issuing a recommendation to move the martyr's remains according to the Form No. 43 Appendix I to this Decree.

+ The representative of the martyr's relatives or the beneficiary of the martyr's worship allowance is responsible for notifying the Department of Labor - Invalids and Social Affairs where the grave is in charge of the relocation of the martyr's remains.

+ The Division of Labor - Invalids and Social Affairs where the martyr's grave is managed within 01 working day from the date of receipt of the notification from the representative of the martyr's relative or the beneficiary of the martyr's worship allowance, shall be responsible for the following: make a notice on the movement of martyrs' remains, according to Form No. 94, Appendix I of this Decree, and send it to the Department of Labor, War Invalids and Social Affairs, where the martyrs' original records are managed and where the martyrs' graves are managed. In case the martyr's remains are not moved to the locality where the dossier is being managed, it shall be sent to the Department, Department of Labor - Invalids and Social Affairs where the martyr's remains are received.

+ The People's Committee of the commune where the martyr's remains are received within 1 working day from the date of receipt of the recommendation letter for the relocation of the martyr's remains shall:

Make a record of the handover of the martyr's remains; organize the burial of martyrs' remains in martyrs' cemeteries; send a written report to the Department of Labor - Invalids and Social Affairs where the martyr's remains are received, together with the introduction paper and the minutes of handing over the martyr's remains.

+ The Division of Labor, War Invalids and Social Affairs where the remains of martyrs are received within 01 working day from the date of receipt of the written report from the commune-level People's Committee with the following papers, shall have to: support money for unloading martyrs' remains, travel and food expenses according to the distance from the place of travel to the martyr's cemetery where the martyr's remains are received. The level of support is specified in Clause 1, Article 10 of Decree No. 75/2021/ND-CP dated July 24, 2021 of the Government.

Send a document to the Department of Labor, War Invalids and Social Affairs where the martyrs' remains are received and where the martyrs' original records are managed, together with the minutes on handing over the martyrs' remains.

+ The Department of Labor, War Invalids and Social Affairs where the martyr's remains are received within 02 working days from the date of receipt of the notice of relocation and the minutes of handing over the martyr's remains, is responsible for updating the information. trust the national database of martyrs; issue notices of martyrs' graves according to Form No. 103 Appendix I of this Decree.

+ The Department of Labor, War Invalids and Social Affairs, which manages the martyr's original file, within 01 working day from the date of receipt of all required documents, is responsible for keeping the notice of the movement of the martyr's remains and minutes of handing over martyrs' remains to martyrs' records.

- In case of receiving support:

+ Representative of the martyr's relatives or the beneficiary of the allowance for martyr worship shall comply with the provisions of Point a, Clause 1 of this Article.

+ Department of Labor - Invalids and Social Affairs where the original dossier is managed; representatives of martyrs' relatives or beneficiaries of martyr's worship allowance; Department of Labor - Invalids and Social Affairs where the martyrs' graves are managed; The commune-level People's Committee where the martyr's remains are received shall comply with the responsibilities specified at Points b, c, d, dd, Clause 1 of this Article.

+ Division of Labor - Invalids and Social Affairs where the remains of martyrs are received within 01 working day from the date of receipt of the report from the commune-level People's Committee, enclosed with written documents to the Department of Labor. - Invalids and Social Affairs where the martyrs' remains are received and where the martyrs' original records are managed together with the minutes of the handover of the martyrs' remains.

+ Department of Labor - Invalids and Social Affairs where the remains of martyrs are received; The Department of Labor, War Invalids and Social Affairs, where the martyrs' original records are managed, shall comply with the responsibilities specified at Points g and h, Clause 1 of this Article.
