The process for preparing the dossier to request recognition of martyrs in 2023 for individuals in the Police force is carried out according to the regulations in Article 5 Circular 14/2023/TT-BCA. Specifically:
Step 1: The police unit or local police where the officer or soldier worked before their death will check, verify, establish, and complete the necessary documents.
- Within 15 days from the date the documents are complete, the police unit or local police will issue a certificate of death and send a written request to the Personnel Department.
- In cases where the officer or soldier dies due to special actions; within 12 days from the date of receiving any of the documents stipulated in Point a Clause 7 Article 17 Decree 131/2021/ND-CP and a copy of the award decision, the police unit or local police will send a written request along with the specified documents to the Ministry of Labor, War Invalids and Social Affairs to propose the organization of nationwide study campaigns.
+ Special actions include: bravely saving people, saving state or people's property, or stopping, arresting criminals, setting examples that honor, educate, and spread widely in society.
+ Within 12 days from the date of receiving the decision to organize the nationwide study campaign, the police unit or local police is responsible for issuing the certificate of death and sending the written request to the Personnel Department.
Step 2: Within 20 days from the date of receiving the complete dossier, the Personnel Department will review and submit it to the leadership of the Ministry of Public Security to sign the document and send the martyr recognition dossier to the Ministry of Labor, War Invalids and Social Affairs for evaluation.
Within 5 days from the date of receiving the "To Quoc Ghi Cong" (The Fatherland Acknowledges Merit) Certificate and a copy of the Prime Minister’s decision to issue the certificate, the Personnel Department will send the martyr dossier to the police unit or local police where the martyr recognition dossier was prepared.
Step 3: Within 15 days from the date of receiving the "To Quoc Ghi Cong" Certificate and a copy of the issued certificate along with the martyr dossier, the police unit or local police will:
- Notify the representative of the martyr's relatives;
- Cooperate with the People's Committee of the commune where the representative of the martyr's relatives resides to organize a memorial service for the martyr and present the "To Quoc Ghi Cong" Certificate to the representative of the martyr's relatives.
If there are no relatives of the martyr, a memorial service will be organized, and the "To Quoc Ghi Cong" Certificate will be handed over to the People's Committee of the commune where the martyr resided before their death.
- Transfer the dossier along with a copy of the "To Quoc Ghi Cong" Certificate to the local Department of Labor, War Invalids and Social Affairs where the memorial service for the martyr is organized.

What is the authority to issue the death certificate?
According to the regulations in Article 16 Decree 131/2021/ND-CP, the authority to issue the death certificate is as follows:

The agency, organization, or unit managing the individual at the time of death has the authority to issue the death certificate as follows:
1. The person who died was an officer, professional soldier, non-commissioned officer, soldier, national defense official, worker, and public defense employee, the death certificate will be issued by the head of the regiment or an equivalent level or higher; the person who died was a code worker, doing other jobs in the code organization, and a code student under the Government Cipher Commission, the certificate will be issued by the head of the unit directly under the commission or higher.
2. The person who died was an officer, non-commissioned officer, soldier, worker, or employee with an indefinite-term contract paid from the police budget, the certificate will be issued by the unit head directly under the Ministry or the Director of Provincial Public Security.
3. The person who died was managed by a central agency, the certificate will be issued by the Minister or an equivalent level.
4. The person who died was managed by a provincial agency, the certificate will be issued by the Chairman of the Provincial People's Committee.
5. The person who died was managed by a district agency, commune agency, and other cases not specified in Clauses 1, 2, 3, and 4, the certificate will be issued by the Chairman of the District People's Committee.
Thus, the authority to issue the death certificate is carried out according to the above regulations.

Based on Article 15 Decree 131/2021/ND-CP on the responsibility for preparing the dossier to request recognition of martyrs is as follows:

1. The agency, organization, or unit directly managing the person who died is responsible for preparing the dossier to request recognition of martyrs.
2. Agencies, organizations, units, and individuals that discover or store information and documents related to an unrecognized martyr's death have the responsibility to provide them to the agency, organization, or unit stipulated in Clause 1 of this Article as a basis for preparing the dossier to request recognition of martyrs.
Thus, according to the regulations, the agency, organization, or unit directly managing the person who died is responsible for preparing the dossier to request recognition of martyrs.
Circular 14/2023/TT-BCA is applicable from June 5, 2023.
