Pursuant to Official Dispatch 796/CD-TTg in 2023 by the Prime Minister on the residential fire incident at 29/70 Khuong Ha Alley, Thanh Xuân District, Hanoi City.
To enhance fire safety and rescue operations in the city, the People's Committee of Ho Chi Minh City has requested the People's Committee of Thu Duc City and the People's Committees of districts and wards to urgently implement the following measures:
Conduct a thorough review, inspection, classification, and evaluation of fire safety measures in dormitories, rental rooms, and microapartments throughout the area. Proactively identify existing issues and violations related to fire safety, rescue operations, and promptly provide guidance and recommendations for corrective actions in accordance with the law.
In cases of serious violations of fire safety regulations, take resolute measures such as temporary suspension or cessation of activities, and handle them strictly in accordance with the law. Complete a report on the implementation results and submit it to the People's Committee (through the City Police) before October 30, 2023.
Direct subordinate units, ward-level People's Committees, and townships to strictly fulfill their responsibilities for state management of fire prevention and firefighting in accordance with the law. Enhance communication and provide guidance to residents on measures, solutions, and evacuation skills in case of fire, explosion, accidents, especially for microapartments and high-density rental accommodations. Instruct and request households to establish secondary escape routes, install fire alarms, fire bells, firefighting equipment, and prepare plans for handling fire, explosion, and accidents.
Strengthen on-site firefighting forces in residential areas with the motto of "prevention is paramount, firefighting is well done" and strive for "safe houses, safe neighborhoods, safe communes, and wards."
Urgently inspect and review the construction and licensing of construction projects within their jurisdictions, especially microapartment complexes, high-density rental accommodations, facilities with high fire and explosion risks, crowded gathering places, and potential fire and explosion hazards in residential areas. Take resolute measures, in accordance with the law, to temporarily suspend or cease operations for cases of violations.
The chairpersons of the local People's Committees are responsible to the chairperson of the Ho Chi Minh City People's Committee and will be subject to legal consequences if they allow construction projects to operate without proper permits, approvals, and fire safety inspections from the competent Fire Prevention, Firefighting, and Rescue Police agency, resulting in fire or explosion incidents.

What are the tasks of Ho Chi Minh City Police in inspecting fire safety?
Pursuant to Official Dispatch 4452/UBND-NCPC, the People's Committee of Ho Chi Minh City requests the city's police force to carry out the following tasks:
Urgently advise the City People's Committee to issue a plan for a comprehensive inspection of fire safety and rescue conditions (abbreviated as PCCC and CNCH) for boarding houses, rental accommodations, microapartments, etc. in the city. Provide guidance to the People's Committee of Thu Duc City and districts to immediately conduct a thorough review, inspection, classification, and evaluation of fire safety measures for these establishments. Complete the task before November 15, 2023, and report the results to the City People's Committee (through the City Police Department).
Strengthen inspection activities for establishments with high fire and explosion risks in residential areas, crowded gathering places, industrial zones, export processing zones, high-tech zones, industrial clusters, and other establishments that may cause significant damage to human lives and properties in the event of a fire. Take decisive actions against violations of fire safety and rescue regulations.
Intensify propaganda, dissemination, and education on fire safety and rescue laws through various specific, practical, and effective measures and solutions. Develop and replicate models and best practices in fire safety and rescue operations, especially measures to ensure fire safety and rescue in densely populated areas and industrial zones.
What are fire safety conditions for microapartments in Vietnam?
Article 5 of Decree 136/2020/ND-CP stipulates fire safety conditions for apartment buildings as follows:
* Apartment buildings less than 5 floors high or with a volume of less than 5,000 m3:
- Regulations, prohibition signs, signage, plans or instruction signs concerning fire prevention, fighting and escape are provided in accordance with fire prevention and fighting regulations and standards or regulations of the Ministry of Public Security;
- There is a firefighting plan approved by the competent authority.
- Power system, lightning protection system, antistatic system, electrical equipment, spark-generating equipment, heat-generating equipment, and the use of fire sources and heat sources must ensure fire safety in accordance with regulations and standards on fire prevention and fighting or regulations of the Ministry of Public Security.
- There are sufficient and quality traffic system, water supply system and communication system supporting fire fighting, system for management of database on fire prevention and fighting, incident notification system, fire alarm system, firefighting system, fire blocking system, smoke blocking system, fire escape system, other fire prevention and fighting equipment, and rescue equipment in accordance with regulations and standards on fire prevention and fighting or regulations of the Ministry of Public Security.
- There are fire prevention and fighting regulations and task assignment. Persons in charge of fire prevention and fighting must join training and refresher courses on fire prevention and fighting operation according to regulations in Article 33 of Decree 136/2020/ND-CP
* Apartments, dormitories, dormitories with 5 floors or more or with a total volume of 5,000 m3 or more.
- - Regulations, prohibition signs, signage, plans or instruction signs concerning fire prevention, fighting and escape are provided in accordance with fire prevention and fighting regulations and standards or regulations of the Ministry of Public Security;
- There are internal and specialized firefighting forces suitable for the facility’s characteristics and having received training in fire prevention and fighting operation, and on-site combat-ready firefighters according to regulations, excluding the case provided for in Point g Clause 2 Article 31 of Decree 136/2020/ND-CP;
- There is a firefighting plan approved by the competent authority;
- Power system, lightning protection system, antistatic system, electrical equipment, spark-generating equipment, heat-generating equipment, and the use of fire sources and heat sources must ensure fire safety in accordance with regulations and standards on fire prevention and fighting or regulations of the Ministry of Public Security;
- There are sufficient and quality traffic system, water supply system and communication system supporting fire fighting, system for management of database on fire prevention and fighting, incident notification system, fire alarm system, firefighting system, fire blocking system, smoke blocking system, fire escape system, other fire prevention and fighting equipment, and rescue equipment in accordance with regulations and standards on fire prevention and fighting or regulations of the Ministry of Public Security;
- The fire safety and firefighting authority (hereinafter referred to as “firefighting authority”) has issued a certificate of design appraisal and design appraisal document (if any) and written approval of fire safety commissioning results for projects and works included in the list in Appendix V enclosed therewith, excluding national defense facilities operating for military purpose and motor vehicles subject to special fire safety requirements manufactured or converted for military purpose by national defense facilities.
Heads of the facility and the regulatory body/ies and/or organization(s) located on the premises thereof must ensure that the fire safety requirements in Clauses 1, 2 and 3 of Decree 136/2020/ND-CP are satisfied before putting the facility to operation and throughout the facility's operation
