No Power Cuts or Repairs During Tet 2024?

On December 12, 2023, Vietnam Electricity Group issued Official Dispatch 7490/EVN-KTSX+KD in 2023 regarding ensuring electricity supply during the Christmas, Solar New Year, and Lunar New Year Giap Thin holidays of 2024.

According to Official Dispatch 7490/EVN-KTSX+KD in 2023, to implement Decision 3110/QD-BCT in 2023 on approving the National Electricity Supply and Operation Plan for 2024 and Official Dispatch 1837/DTDL-HTD in 2023 of the Electricity Regulatory Authority regarding the provision of electricity during the Solar and Lunar New Year Giap Thin holidays in 2024 (attached documents).

According to Section 1 of Official Dispatch 7490/EVN-KTSX+KD in 2023, Vietnam Electricity Group requires electricity suppliers not to carry out activities that require stopping or reducing the electricity supply, causing power outages for customers.

Except in case of emergencies, during these days:

- Christmas - from 0:00 December 24 to 24:00 December 25, 2023;- Solar New Year - from 0:00 December 30, 2023, to 24:00 January 1, 2024;- Lunar New Year 2024 - from 0:00 February 8, 2024 (the 29th Tet day) to 24:00 February 14, 2024 (the 5th Tet day).

During the aforementioned period, there should be no power cuts or repairs that lead to stopping or reducing electricity supply, except in case of emergencies.

Solar New Year 2024 Holiday Schedule:

Based on point a, clause 1, Article 112 of the Labor Code 2019, officials and public employees are entitled to one day off with full pay during the Solar New Year: January 1. In 2024, the Solar New Year falls on Monday, January 1, 2024, and officials and public employees will have a day off with full pay on this day.

However, December 30 and December 31, 2023, fall on Saturday and Sunday. Thus, the Solar New Year 2024 holiday for officials and public employees will be extended to a continuous 3-day period from Saturday, December 30, 2023, to Monday, January 1, 2024 (provided they have a Saturday and Sunday weekend).

Lunar New Year 2024 Holiday Schedule:

- For officials and public employees:

On November 22, 2023, the Ministry of Labor, Invalids and Social Affairs announced the Lunar New Year Giap Thin and National Day holidays of 2024 for officials and public employees and workers.

According to Announcement 5015/TB-LDTBXH in 2023 of the Ministry of Labor, Invalids and Social Affairs (MOLISA), officials and public employees and workers are entitled to a 2024 Lunar New Year holiday from Thursday, February 8, 2024 (the 29th day of the twelfth lunar month of Quy Mao year) to Wednesday, February 14, 2024 (the 5th day of the first lunar month of Giap Thin year).

(The Lunar New Year holiday includes 5 days of Lunar New Year and 2 compensatory days in place of the weekly days off as stipulated in clause 3, Article 111 of the Labor Code 2019).

What Types of Fireworks are People Allowed to Use During Lunar New Year 2024?

Article 17 of Decree 137/2020/ND-CP stipulates cases in which fireworks can be used:

1. Agencies, organizations, businesses, and individuals with full civil act capacity are allowed to use fireworks in the following cases: Holidays, Tet, birthdays, weddings, conferences, openings, and commemorations.

2. Agencies, organizations, businesses, and individuals using fireworks must purchase fireworks only from authorized manufacturing and trading organizations or businesses.

According to clause 1, Article 3 of Decree 137/2020/ND-CP, the definitions of fireworks are as follows:

Definitions

In this Decree, the following terms are understood as follows:

1. Fireworks are products containing gunpowder, which, when subjected to mechanical, thermal, chemical, or electrical stimulation, cause a rapid and strong chemical reaction, generating gas, creating sound, light, and color effects in space, causing either a sound or no sound. Fireworks include: firecrackers and fireworks.

a) Firecrackers are products made, either manually or industrially, that, when subjected to mechanical, thermal, chemical, or electrical stimulation, cause either a sound or a hissing, sound, and color effects in space;

Firecrackers causing hissing sounds, sounds, and color effects in space are called exploding fireworks;

Low-level exploding fireworks are firework rounds with a diameter of not more than 90 mm or a shooting distance not exceeding 120 m. High-level exploding fireworks are firework rounds with a diameter exceeding 90 mm or a shooting distance exceeding 120 m;

b) Fireworks are products made, either manually or industrially, that, when subjected to mechanical, thermal, chemical, or electrical stimulation, create sound, light, color effects in space without causing any sound.

Thus, clause 1, Article 3 of Decree 137/2020/ND-CP explains the two concepts of fireworks and exploding fireworks as follows:

- Exploding fireworks are the type that causes hissing sounds, sounds, and color effects in space.

- Low-level exploding fireworks are rounds with a diameter not exceeding 90 mm or a shooting distance not exceeding 120 m. High-level exploding fireworks are rounds with a diameter exceeding 90 mm or a shooting distance exceeding 120 m.

To use exploding fireworks, permission is required, and they can only be fired on occasions such as Tet, Hung Kings' Death Anniversary, National Day... (according to Article 11 of Decree 137/2020/ND-CP).

- Fireworks are products made, either manually or industrially, that, when subjected to mechanical, thermal, chemical, or electrical stimulation, create sound, light, color effects in space without causing any sound.

According to the above regulations, the fireworks that the public can use are different from exploding fireworks. The type of fireworks that the public is allowed to use are those that do not cause sounds. The difference between normal fireworks and exploding fireworks is that they do not cause any sounds or hissing.
