Every month, the Ministry of Justice of Vietnam organizes consideration of regular pay raises for officials, public employees and employees who fully meet the conditions and criteria for pay raise in the following month and under the authority of the Ministers of Ministry of Justice of Vietnam, according to decentralization, manage officials and public employees.

What are the time conditions for consideration of a regular pay raise in Vietnam in 2022?

According to Article 4 of Decision 1496/QD-BTP in 2022, the conditions for consideration of regular pay raise are as follows:

- Conditions of time for regular pay raise, time to be counted or not included in the time of regular pay raise consideration, extended time for consideration of regular pay raise, the re-calculation of regimes on promotion Regular salary shall comply with the provisions of Article 2 of Circular 08/2013/TT-BNV as amended and supplemented in Clauses 2 and 3, Article 1 of Circular 03/2021/TT-BNV as follows:

"Article 2. Regular pay raise regime
The subjects specified in Clause 1, Article 1 of this Circular, if the final salary level has not been ranked in the official rank (hereinafter referred to as the rank), in the public employee's professional title, the title of senior expert and the professional title, The professional subjects and professions of the Court or Procuracy sector (hereinafter referred to as the title) currently held, shall be considered for a regular pay raise when meeting the conditions for holding the rank in the rank or title and meeting the criteria. The standard for regular pay raise as prescribed in Clauses 1 and 2 of this Article during the period of keeping the salary grade is as follows:
1. Conditions for holding a rank in a rank or in a title:
a) Period of holding rank for consideration of regular pay raise:
- For the title of senior expert: If the last salary level has not been ranked in the senior expert's salary list, then after 5 years (60 months) holding the salary level in the senior expert's salary list will be considered for a pay raise. ;
- For ranks and titles that require a college degree or higher: If the last salary level has not been ranked in the rank or title, after 3 years (full 36 months) to keep the salary level in the rank considered to raise a salary level in the rank;

- The time when the competent authority decides to send them to work as experts, to study, to practice, to work or to conduct surveys in the country or abroad (including the time when they are under the regime of spouses and husbands according to the regulations of the Government) but still on the salary list of agencies and units.
- The period of time when officials, public employees and employees participate in active service according to the Law on Military Service
c) Time is not counted to consider for a regular pay raise, including:
- The time off without pay;
- The time spent working as an expert, studying, practicing, working or surveying at home and abroad exceeds the time limit decided by the competent authority;
- The period of work suspension, temporary detention, detention and other types of non-working time other than those specified at Point b, Clause 1 of this Article.
The sum of all types of time that is not counted for consideration of raising the regular salary level specified at this Point (if any) is counted as a full month, if there is an odd period of less than a month, it is calculated as follows: Less than 11 working days (excluding weekly rest days and working days off with full salary as prescribed by labor law) are not counted; from 11 working days or more is counted as 01 month.
- The probationary period (including the case of receiving 100% of the salary of the official rank, the professional title of the probationary public employee).
- The time of officials, public employees and employees deserting in the course of performing active military service.
- The probation period for cadres, officials, public employees and employees who are sentenced to prison but given suspended sentences; in case the probationary period is less than the extended period, the regular salary level increase is calculated according to the extended period, and the regular salary level is raised.
- The time off until reaching retirement age according to current provisions of law.

What are the conditions to consider a regular pay raise for officials, public employees and employees of the Ministry of Justice of Vietnam?

"Article 2. Regular pay raise regime

The subjects specified in Clause 1, Article 1 of this Circular are fully qualified for the period of holding the rank in the ranks or in the titles specified in Clause 1 of this Article and have been assessed to satisfy the following 02 criteria during the period of holding the rank salary is increased by a regular salary level:
a) For officials:
Standard 1: Be evaluated and graded by a competent authority at the level of task completion or higher
- Standard 2: Do not violate discipline in one of the forms of reprimand, warning, demotion or dismissal.
b) For public employees and employees:
- Standard 1: Be assessed by a competent authority from the level of task completion or higher;
- Standard 2: Do not violate discipline in one of the forms of reprimand, warning or dismissal."
