What are using purposes of results of the vote of confidence for positions elected or approved by the National Assembly of Vietnam?

Based on Article 12 of Resolution 96/2023/QH15, the provisions are as follows:

Consequences for the person receiving the vote of confidence

1. The results of the vote of confidence are used to evaluate officials and serve as a basis for planning, transferring, appointing, nominating for candidacy, dismissal, and implementing policies for officials.

2. A person receiving a vote of confidence with more than half to less than two-thirds of the total votes rated as “low confidence” may resign; if they do not resign, the Standing Committee of the National Assembly of Vietnam shall present to the National Assembly of Vietnam, and the Standing Committee of the People's Council shall present to the People's Council, to conduct a vote of confidence in that session or the nearest session; if a person has received votes of confidence for multiple positions at the same time, the vote of confidence is conducted once for those positions.

3. A person receiving a vote of confidence with two-thirds or more of the total votes rated as “low confidence” shall be proposed by the authorized body or person who introduced them to the National Assembly of Vietnam or People's Council for election or approval to present to the National Assembly of Vietnam or People's Council to proceed with dismissal or approval of the dismissal proposal in that session or the nearest session; if a person has received votes of confidence for multiple positions at the same time, the dismissal or approval of the dismissal proposal is conducted once for those positions.

Thus, the results of the vote of confidence for positions elected or approved by the National Assembly of Vietnam are used to evaluate officials, serve as a basis for planning, transferring, appointing, nominating for candidacy, dismissal, and implementing policies for officials.

A person receiving a vote of confidence with more than half to less than two-thirds of the total votes rated as “low confidence” may resign.

1. The results of the vote of confidence for each person are announced publicly by the Vote Counting Committee at the meeting, including the following details:

a) Name, position of the person receiving the vote of confidence;

b) Number of votes issued, number of votes collected, and number of valid votes;

c) Number of “high confidence” votes, percentage compared to the total votes;

d) Number of “confidence” votes, percentage compared to the total votes;

dd) Number of “low confidence” votes, percentage compared to the total votes.

The results of the vote of confidence for positions elected or approved by the National Assembly of Vietnam are publicly announced by the Vote Counting Committee at the meeting and include the contents specified in Clause 1, Article 19 as mentioned above.

What principles must be followed in the vote of confidence, vote of no confidence for positions elected or approved by the National Assembly of Vietnam?

Based on Article 5 of Resolution 96/2023/QH15, the principles for the vote of confidence, vote of no confidence are as follows:

- Ensure the rights and emphasize the responsibilities of National Assembly of Vietnam deputies and People's Council deputies in the vote of confidence, vote of no confidence; ensure the right to report and explain by the person receiving the vote of confidence, vote of no confidence.

- Democratic, objective, fair, public, transparent; ensure the correct and substantive evaluation of the performance results of duties, powers, and political qualities, ethics, and lifestyle of the person receiving the vote of confidence, vote of no confidence.

- Ensure the stability and efficiency of the state apparatus, the leadership of the Communist Party in personnel work.
