Decree 33/2023/ND-CP on the latest commune-level officials?
On June 10, 2023, the Government of Vietnam issued Decree 33/2023/ND-CP on commune-level officials and non-specialized activists at the commune level, in villages, and residential groups.
This Decree stipulates positions, titles, quantity, standards, duties, policies, election, recruitment, utilization, and management of officials at communes, wards, commune-level towns (hereinafter referred to as commune level) and non-specialized activists at the commune level, in villages, and residential groups.
According to Decree 33/2023/ND-CP, does the commune-level official have 6 titles from August 1, 2023?
According to Decree 33/2023/ND-CP, commune-level officials hold the following positions:
- Secretary, Deputy Secretary of the Communist Party Committee;- Chairman, Vice Chairman of the People's Council;- Chairman, Vice Chairman of the People's Committee;- Chairman of the Vietnam Fatherland Front Committee;- Secretary of the Ho Chi Minh Communist Youth Union;- Chairman of the Vietnam Women's Union;- Chairman of the Vietnam Farmers' Union (applicable to communes, wards, commune-level towns with agricultural, forestry, fishery, and salt production activities and having a Vietnam Farmers' Union organization);- Chairman of the Vietnam Veterans' Association.
Additionally, Decree 33/2023/ND-CP specifies only 6 titles for commune-level officials as the title of head of commune police is no longer included, specifically:
- Commander of the Commune Military Command Board;- Office - Statistics;- Land - Construction - Urban and Environment (for wards, commune-level towns) or Land - Agriculture - Construction and Environment (for communes);- Finance - Accounting;- Justice - Civil status;- Culture - Society.

What is the latest allowance regime for non-specialized activists at the commune level?
Non-specialized activists at the commune level are entitled to allowance policies. The Central Budget implements an allowance fund, including support for social insurance and health insurance payments, to make monthly payments to non-specialized activists at the commune level as stipulated in Article 34 Decree 33/2023/ND-CP as follows:
Commune-level administrative units of category I are allocated an allowance fund equal to 21.0 times the statutory pay rate;
Commune-level administrative units of category II are allocated an allowance fund equal to 18.0 times the statutory pay rate;
Commune-level administrative units of category III are allocated an allowance fund equal to 15.0 times the statutory pay rate.
For commune-level administrative units with an increased number of non-specialized activists, the total allocated allowance fund is increased accordingly by 1.5 times the statutory pay rate per additional non-specialized activist.
An allowance fund is allocated for non-specialized activists in villages and residential groups. The Central Budget allocates an allowance fund for monthly payments to non-specialized activists in each village and residential group as follows:
- For villages with 350 or more households; residential groups with 500 or more households; villages and residential groups in commune-level administrative units that are key and complex in terms of security and order as decided by competent authorities; villages and residential groups in border, island commune-level administrative units are allocated an allowance fund equal to 6.0 times the statutory pay rate. In case a village with 350 or more households is converted into a residential group due to the establishment of an urban commune-level administrative unit, it retains the allowance fund allocation of 6.0 times the statutory pay rate;
- For villages and residential groups not falling under point a above, an allowance fund allocation equal to 4.5 times the statutory pay rate is provided;
- If a district-level administrative unit does not organize commune-level administrative units, the villages, and residential groups defined at points a and b above are determined according to such district-level administrative unit.
* Based on the allowance fund allocated by the Central Budget to each commune level, each village, and residential group as specified in clauses 1 and 2 of this Article; the local budget for implementing wage policy reform; relevant legal provisions and the specific characteristics of each commune level, village, and residential group, the People's Committee at the provincial level submits to the People's Council at the same level for specific regulations on the following contents:
- Titles of non-specialized activists at the commune level;- Concurrent holding of titles by non-specialized activists at the commune level, in villages, and residential groups and the concurrent involvement of non-specialized activists in villages and residential groups and direct participation in village and residential group activities;- Allowance levels for each title of non-specialized activists at the commune level, in villages, and residential groups ensuring reasonable correlation with the salary of the first grade commune-level official with the same educational level to encourage non-specialized activists at the commune level, in villages, and residential groups to further their professional training; specific regulations on the activity fund of socio-political organizations at the commune level; monthly allowances for those directly involved in village and residential group activities and additional allowances for those directly involved in village and residential group activities concurrently.
Decree 33/2023/ND-CP takes effect from August 1, 2023.
