Vietnam: Which public holidays are employees entitled to in 2024?
Based on Article 112 of Labor Code 2019 which stipulates:
Public Holidays
- Employees are entitled to leave from work with full pay on the following holidays and Tet festivals:

b) Lunar New Year: 05 days;
c) Victory Day: 01 day (April 30 of the Gregorian calendar);

e) Hung Kings' Commemoration Day: 01 day (March 10 of the lunar calendar).

- Annually, based on actual conditions, the Prime Minister shall decide on specific holidays stipulated at Points b and đ Clause 1 of this Article.

(6) Hung Kings' Commemoration Day: 01 day (March 10 of the lunar calendar).
Additionally, foreign employees working in Vietnam will have an extra day for their traditional New Year and an additional day for their national day besides the holidays mentioned above.
If a weekly day-off coincides with a holiday or Tet as prescribed in Clause 1, Article 112 of Labor Code 2019, employees are entitled to a compensatory day-off immediately following the weekly day-off.
What is the schedule for Tet holiday in Vietnam in 2024?
For officials and public employees:
On November 22, 2023, the Ministry of Labor, War Invalids, and Social Affairs announced the schedule for Tet (Lunar New Year) Giap Thin and National Day holiday in 2024 for officials, public employees, and workers.
According to Announcement 5015/TB-LDTBXH of 2023 by the Ministry of Labor – War Invalids and Social Affairs (MOLISA), officials, public employees, and workers in government administrative agencies will have Tet (Lunar New Year) 2024 off from Thursday, February 08, 2024, of the Gregorian calendar (equivalent to the 29th day of the 12th lunar month of the Year of the Cat) until Wednesday, February 14, 2024, of the Gregorian calendar (equivalent to the 5th day of the Year of the Dragon).
(The Tet holiday schedule includes 05 days of Lunar New Year holidays and 02 compensatory days for weekly day-offs as stipulated in Clause 3, Article 111 of Labor Code 2019).
For employees:
According to Article 112 of Labor Code 2019, employees are entitled to leave from work with full pay for 05 days during the Lunar New Year.
Additionally, Section 5 of Announcement 5015/TB-LDTBXH of 2023 specifies the options for the Lunar New Year holiday in 2024 for employees as follows:
- For the Lunar New Year holiday: choose either 01 day at the end of the Year of the Cat and 04 days at the beginning of the Year of the Dragon or 02 days at the end of the Year of the Cat and 03 days at the beginning of the Year of the Dragon or 03 days at the end of the Year of the Cat and 02 days at the beginning of the Year of the Dragon.
- Notify employees of the Lunar New Year holiday schedule at least 30 days prior to implementation.
- If a weekly day-off coincides with a holiday or Tet as prescribed in Clause 1, Article 112 of Labor Code 2019, employees are entitled to a compensatory day-off immediately following the weekly day-off as stipulated in Clause 3, Article 111 of Labor Code 2019.
- Employers are encouraged to apply the same holiday schedule for employees as that for officials and public employees.
