Is it necessary for an individual who wants to purchase health insurance together with their family to have their name on the household registration book?
Does an individual need to have their name in the household registration book to purchase health insurance with their family?
Based on Article 5 of Decree 146/2018/ND-CP, the group of participants in health insurance by household is specified as follows:
- People whose names are in the household registration book, except for those falling under the provisions of Articles 1, 2, 3, 4, and 6 of this Decree.
- People whose names are in the temporary residence registration book, except for those falling under the provisions of Articles 1, 2, 3, 4, and 6 of this Decree and those who have already participated in health insurance according to the provisions of Clause 1 of this Article.
- The following subjects are allowed to participate in household health insurance:
+ Religious dignitaries and clergy;
+ People living in social protection establishments, except for those falling under the provisions of Articles 1, 2, 3, 4, and 6 of this Decree who are not supported by the state budget to pay for health insurance.
Additionally, according to Clause 7 Article 2 of the 2008 Health Insurance Law (amended by Clause 2 Article 37 of the 2020 Residence Law), it is recognized that households participating in health insurance (hereinafter referred to as households) are those who register for permanent or temporary residence at one legal place of residence according to residence law.
Thus, if one wants to purchase health insurance with their family, i.e., purchase by household, it only requires the name to be on the household registration book to be eligible to buy health insurance under the household category.

What is the payment level for health insurance participation by household?
Based on Article 13 of the 2008 Health Insurance Law (amended by Clause 7 Article 1 of the 2014 Amended Health Insurance Law), the health insurance payment levels are specified as follows:
- The payment levels and responsibilities for paying health insurance are defined as follows:
+ The monthly payment for subjects specified in point a, clause 1 of this Article is up to 6% of the monthly salary, wherein the employer pays 2/3 and the employee pays 1/3. During the period of maternity leave as per social insurance law, the monthly payment is up to 6% of the monthly salary before maternity leave and is paid by the social insurance organization.
+ The monthly payment for subjects specified in point b, clause 1 of this Article is up to 6% of the statutory pay rate, wherein the employer pays 2/3 and the employee pays 1/3.
+ The monthly payment for subjects specified in point a, clause 2 of this Article is up to 6% of the retirement and labor loss allowance and is paid by the social insurance organization.
+ The monthly payment for subjects specified in points b and c, clause 2 of this Article is up to 6% of the statutory pay rate and is paid by the social insurance organization.
+ The monthly payment for subjects specified in point d, clause 2 of this Article is up to 6% of the unemployment allowance and is paid by the social insurance organization.
+ The monthly payment for subjects specified in point a, clause 3 of this Article is up to 6% of the monthly salary for wage earners, or up to 6% of the statutory pay rate for those receiving living allowances, and is paid by the state budget.
+ The monthly payment for subjects specified in points b, c, d, dd, e, g, h, i, k, l, and m of clause 3 of this Article is up to 6% of the statutory pay rate and is paid by the state budget.
+ The monthly payment for subjects specified in point n, clause 3 of this Article is up to 6% of the statutory pay rate and is paid by the organization that provides the scholarship.
+ The monthly payment for subjects specified in clause 4 of this Article is up to 6% of the statutory pay rate, and is self-paid by the subject, with partial support from the state budget.
+ The monthly payment for subjects specified in clause 5 of this Article is up to 6% of the statutory pay rate and is paid by the subject according to the household.
- In cases where one person falls under different health insurance categories specified in Article 12 of this Law, they shall pay health insurance according to the first category as determined in the order of categories in Article 12 of this Law.
If the subject specified in point a, clause 1 of Article 12 of this Law has one or more indefinite-term or fixed-term labor contracts of 3 months or longer, they will pay health insurance according to the labor contract with the highest salary.
If the subject specified in point b, clause 1 of Article 12 of this Law simultaneously belongs to multiple health insurance categories specified in Article 12 of this Law, they will pay health insurance in the following order: paid by the social insurance organization, paid by the state budget, paid by the subject and the commune People's Committee.
- All family members as specified in clause 5 of Article 12 of this Law must participate in health insurance. The payment rate decreases from the second member onwards. To be specific:
+ The first member pays up to 6% of the statutory pay rate;
+ The second, third, and fourth members pay respectively 70%, 60%, 50% of the first member's rate;
+ From the fifth member onwards, the payment rate is 40% of the first member's rate.
- The Government of Vietnam stipulates in detail the payment rates and support levels specified in this Article.
What is the maximum health insurance payment for 2023?
According to Clause 5 Article 14 of the 2008 Health Insurance Law (amended by Clause 8 Article 1 of the 2014 Amended Health Insurance Law), the maximum monthly salary for calculating the health insurance payment is 20 times the statutory pay rate.
Currently, the statutory pay rate as regulated in Clause 2 Article 3 of Decree 38/2019/ND-CP, applicable until June 30, 2023, is 1,490,000 VND. Therefore, the maximum monthly salary for calculating the health insurance payment is 29,800,000 VND.
In the afternoon of November 11, 2022, during the fourth session of the XV National Assembly, a Resolution was passed that clearly stated an increase in the statutory pay rate for officials and public employees to 1.8 million VND/month. As a result, the maximum monthly salary for calculating the health insurance payment will rise to 36 million VND from July 1, 2023.
