* Preschool:
Pursuant to the provisions of Article 26 of the Law on Education 2019, institutions of preschool education include:
- Junior kindergarten centers and classes for children aged 03 – 36 months;
- Senior kindergartens and independent senior kindergarten classes for children aged 03 – 06 years;
- Combined kindergartens and independent preschool classes for children aged 03 months – 06 years.
Accordingly, the organizational structure of an independent daycare group more than 07 children, independent kindergarten class, independent nursery class includes: owner; specialized manager; teachers, staff (if any) and daycare groups and kindergarten classes. (Article 10 of Circular 49/2021/TT-BGDDT)
* Owners
Pursuant to Article 11 of Circular 49/2021/TT-BGDDT, Owner is a person or authorized person for the account of an organization who applies for establishment of an independent nursery education institution.
(1) Qualifications
- Be a citizen of the Socialist Republic of Vietnam;
- Have good moral qualities;
- Under 65 years old;
- Fit for work;
- Have a high school diploma or higher.
(2) Duties and entitlements
- Duties
+ Direct and administer the children’s care and education;
+ Give fair treatment and respect personality of children, teachers and staff;
+ Direct and build an environment that is safe, healthy, friendly and free of violence;
+ Purchase and manage facilities, equipment, utensils, toys, learning materials and documents catering for the children rearing, care and education;
+ Ensure benefits and polies for teachers and staff as prescribed;
+ Comply with regulations on disclosure.
- Entitlements
+ Sign employment contracts with teachers and staff as prescribed;
+ Also play as specialized manager, teacher or staff member if fully qualified as prescribed;
+ Agree a given tuition fee with children’s parents or guardians;
+ Attend refresher courses in politics, professional practices, administration;
+ Receive benefits as prescribed.

Pursuant to Clause 3, Article 12 of the Law on Education 2019, the certificates of the national educational system are granted to learners to acknowledge their learning results upon successful completion of courses for knowledge or professional upgrading or conferred to candidates of certification examinations as prescribed by law.

In addition, according to Article 13 of the Regulation issued together with Decision 31/2008/QD-BGDDT, learners are granted a certificate of pedagogical training when:
- Complete the pedagogical professional training program as prescribed
- Do not in the period of criminal prosecution.
And the head of the training institution shall grant a certificate of pedagogical training to students who meet the conditions specified in Clause 1, Article 13 of the Regulation issued together with Decision 31/2008/QD-BGDDT.
Is it compulsory for owners of institutions of preschool education in Vietnam to possess a pedagogical diploma?
Pursuant to the provisions on standards for the owner of a preschool educational institution in Article 11 of Circular 49/2021/TT-BGDDT, the owner of a preschool education institution is not required to have a pedagogical diploma. Therefore, it can be understood that in order to establish a preschool, a pedagogical diploma is not required.
However, Article 12 of Circular 49/2021/TT-BGDDT still requires professional managers of preschool education institutions to have a college degree in preschool pedagogy or higher.
- Specialized manager is designated by the owner of the independent nursery education institution in an employment contract. The owner, a teacher or staff member may concurrently hold the specialized manager position if fully qualified as prescribed.
- Manage the taking care and education of children in conformity with the nursery education program, including:
+ Make and initiate the plan for children’s care and education of the independent nursery education institution in conformity with the nursery education program;
+ Inspect and supervise how teachers and staff in the independent nursery education institution take care of and educate children;
+ Suggest assignment of teachers and staff in performing specialized tasks;
+ Make plans for specialized activities; provide training in specialized and professional guidelines for teachers and staff;
+ Participate in evaluation, grading, suggest commendation for and disciplinary actions against teachers and staff as prescribed;
+ Be liable for every professional activities, records in service of the children’s care and education and implementation of the nursery education program;
+ Self-learn and improve the managerial capability;
+ Perform tasks and exercise entitlement as agreed in the employment contract with the owner of the independent nursery education institution.
