Pursuant to subsection 15, Section 1, Appendix 2 promulgated together with Decision No. 1085/QD-BTNMT in 2023, guiding the registration of the certificate of land use rights in the case of transferring the land use rights before July 1, 2014, but the procedures have not been carried out as follows:
(1) The land user submits the application at the Land Registration Office or the Branch of the Land Registration Office or the application-receiving agency according to the regulations of the People's Committee of the province or according to the needs of the localities where the People's Committee of the province has promulgated the regulation on receipt, rotation of dossiers, settlement and return of the results of processing procedures according to location needs.
Households, individuals and communities shall submit dossiers to the commune-level People's Committees if they wish.
In case of receiving incomplete or invalid dossiers, within a maximum of 03 days, the dossier-receiving and processing agencies must notify and guide the dossier-submitters to supplement and complete the dossiers in accordance with regulations.
(2) The application-receiving agency is responsible for recording all information in the record-receiving book and returning the results and handing over the application-receiving slip and returning the results to the applicant.
(3) The land registration office or the branch of the land registration office shall notify in writing the transferor and post it up at the headquarters of the commune-level People's Committee of the locality where the land is located about carrying out the procedures for issuance of a certificate of land use rights and ownership of houses and other land-attached assets to the transferee.
- If the address of the transferor is unknown, the notice must be posted on the local mass media for three consecutive numbers.
- After 30 days from the date of announcement or first posting on the local mass media, if there is no application for dispute settlement, the and registration office or the branch of the land registration office shall compile a dossier to submit to the competent authority for decision to cancel the issued Certificate in case of failure to submit the Certificate to carry out procedures and concurrently grant a new Certificate of land use rights and ownership of houses and other land-attached assets to the transferee.
In case there is an application for dispute settlement, the Land Registration Office or the Branch of the Land Registration Office shall guide the parties to submit the application to the competent state agency for dispute settlement according to regulations.

+ An application for registration of changes in land and properties attached to land;
+ The contract or document on transfer of rights made according to regulations;
- In case of receiving the transfer or donation of land use rights but do not make a contract, the document on transfer of the right as prescribed, the application includes:
+ An application for registration of changes in land and properties attached to land;
+ The original of the issued Certificate;
+ Papers on the transfer of land use rights and land-attached assets with full signatures of the transferor and the transferee.
- For the case of carrying out the procedures for registration of changes in land or property on land, but there is a change in information about the legal entity, the number of the people's identity card, the number of the citizen's identity card, the address on the certificate If the certificate has been granted, the land user shall submit the following additional documents:
+ A copy of the new people's identity card or new military ID card or a copy of the new citizen's identity card or personal identification number or other document proving the change of identity in case of change of personal information; the body of the person named on the Certificate;
In case the national data on population is shared and connected with data of sectors and fields (including the land sector), the receiving agency shall use data from the database. country of population that does not require applicants to submit a copy of their National Identity Card or Military ID or a copy of a new citizen identification or personal identification number or other document to prove their identity.
