According to the provisions of the investment law, the reason for requesting the extension of land use term shall be specified at Point 4 of the Application for registration of changes in land and land-attached assets, made according to form No. 09/DK.

- Proof of fulfillment of financial obligations (if any).

What are the procedures for extension of duration of land use outside high-tech zones and economic zones in Vietnam?

According to the guidance in subsection 23, Section 1, Appendix 2 issued together with Decision No. 1085/QD-BTNMT in 2023 as follows:

- Land users wishing to extend the time limit shall submit the application for extension of land use term at the Land Registration Office or the Land Registration Office's branch or the dossier-receiving agency in accordance with regulations of the People's Committees of provinces or locations according to needs, for localities where the provincial People's Committees have issued regulations on receiving, circulating dossiers, processing and returning results of settlement procedures according to the needs of the location.

Households, individuals and communities shall submit dossiers to the commune-level People's Committees if they wish.

In case of receiving incomplete or invalid dossiers, within a maximum of 03 days, the dossier-receiving and processing agencies must notify and guide the dossier-submitters to supplement and complete the dossiers in accordance with regulations. .

- The dossier-receiving agency shall record all information in the dossier-receiving book and return the results, hand over the dossier-receiving slip and return the results to the applicant.

If the dossier is submitted at the commune-level People's Committee, within 03 working days from the date of receipt of the complete dossier, the commune-level People's Committee must transfer the dossier to the land registration office.

- The land registration office transfers the dossier to the natural resources and environment agency.

- The natural resources and environment agency is responsible for appraising the land use demand; if the conditions for extension are satisfied, the land registration office shall be assigned to send cadastral information to the tax office for determination of financial obligations; submit to the People's Committee of the same level to decide on extension of land use rights; sign land lease contract in case of land lease; Transfer the dossier to the Land Registration Office for registration.

- The land user shall submit the granted certificate and proof of fulfillment of financial obligations in the case of extension of duration of land use to the natural resources and environment agency;

- The land registration office is responsible for certifying the extension of land use in the issued Certificate; handing over the Certificate to the grantee or sending it to the commune-level People's Committee for handing in case the dossier is submitted at the commune level.
