In case of having a stroke that causes to suffer from hemiplegia on half of the body while working abroad, can the Fund for Overseas Employment Support assist the cost of returning home?

My friend and I went to work abroad together in Korea. Last week, while at work, my friend gradually fainted and passed out. After being admitted to hospitals in Korea, the doctors said that my friend had a stroke and now she suffers from hemiplegia in the lower half of her body. With her condition now she can't continue to work anymore. So I would like to ask if my friend's case is like that, can the Fund for Overseas Employment Support assist the costs so that you can return home? If yes, how much does the Fund support her? Article 3 of Decision 40/2021/QD-TTg of Vietnam stipulates the establishment of the Fund for Overseas Employment Support specifically as follows:

1. Establishment of the Fund for Overseas Employment Support under the Ministry of Labor, War Invalids and Social Affairs to support the development, stability and expansion of the market; prevent, reduce and overcome risks to employees and businesses; protect the legitimate rights and interests of employees.

3. Transaction name in English of the Fund: Fund for Overseas Employment Support, abbreviated as FES.

Principles for supporting employees of the Fund for Overseas Employment Support

Pursuant to Article 9 of Decision 40/2021/QD-TTg of Vietnam stipulating the principles for supporting employees of the Fund for Overseas Employment Support, specifically as follows:

1. Employees are supported under the provisions of this Decision when making full contributions to the Fund. The time of application of support is counted from the time the employee contributes to the fund.

2. Employees are supported 01 time for each support content specified in this Decision for 01 time contribution to the Fund.

3. The contents specified in Article 10, Article 11, Article 12 and Article 13 of this Decision only apply to cases arising during the time the employee works abroad under the contract.

4. In case the employees have received vocational training support policies from programs, projects and policies under the state budget, they are not entitled to support as prescribed in Article 15 of this Decision and vice versa.

5. The contents of support from the Fund do not reduce, change or eliminate the rights and obligations of employees, and obligations of employers, enterprises and sending organizations towards employees in accordance with provisions of the Law on Vietnamese employees working abroad under contracts and other legal provisions.

Are employees suffering from hemiplegia assisted by the Fund for Overseas Employment Support?

Article 10 of Decision 40/2021/QD-TTg of Vietnam stipulates support for employees who have to return home ahead of time due to such an occupational accident, accident, illness, or disease that they are no longer able to continue working abroad as follows:

1. Support level: from VND 10,000,000 to VND 30,000,000/case.

2. The employee or the employee's authorized person or the employee's legal representative shall send a request for support (Form according to Appendix I enclosed with this Decision) enclosed with 01 dossier evidence in one of the following forms: online, in person, by post or through an enterprise, organization or individual taking it to the Fund's operating agency. Profile include:

a) A copy of the document on liquidation of the contract signed between the sending enterprise, organization or individual and the employee, clearly stating the reason for returning home ahead of time; or written notice of the employer about the termination of the contract with the employee for the above reasons;

b) A copy of the employee's medical examination paper or other papers proving the disease or injury status issued by the health authority of the host country;

c) A copy of the employee's passport;

d) A written authorization (specifying the content of authorization) or documents proving the right to represent at law as prescribed in case the authorized person or the legal representative submits the dossier.

In case the application is submitted through an enterprise, organization or individual, the unit or individual shall make a list of employees requesting support, together with the employee's dossier, and send it to the Fund's executive agency (Form No. Appendix II issued together with this Decision).

3. Within 15 working days from the date of receipt of a complete dossier as prescribed, the Fund operating agency shall check, compare the dossier and provide support at the request of the employee. In case of non-support, they must reply in writing and clearly state the reason.

Thus, for your specific case, your friend will be supported by the Fund for Overseas Employment Support with a maximum amount of VND 30,000,000.
