“Article 16. Violations against regulations on environmental monitoring and supervision

1. Penalties for violations against regulations on automatic and continuous monitoring of industrial wastewater, dust and gas emissions:

a) A fine ranging from VND 50,000,000 to VND 60,000,000 shall be imposed for installing an automatic and continuous monitoring system for industrial waste water, dust, and exhaust gas within the prescribed time limit;

b) A fine ranging from VND 80,000,000 to VND 100,000,000 shall be imposed for using automatic and continuous monitoring equipment that fails to meet technical requirements for an automatic and continuous wastewater monitoring system, dust, industrial emissions as prescribed; failure to operate, improperly or incompletely the process according to the requirements on management and operation of the system for automatic and continuous wastewater monitoring systems or automatic industrial dust and gas emission monitoring systems. dynamic, continuous; failing to install cameras to monitor the automatic and continuous monitoring system of wastewater, dust and industrial emissions as prescribed; do not install automatic sampling device for wastewater at automatic and continuous monitoring system of wastewater; failing to keep monitoring data of wastewater, dust and industrial emissions as prescribed or failing to connect and transmit monitoring data to competent authorities as prescribed;

dd) For acts of failing to inspect and calibrate the automatic and continuous industrial wastewater, dust and gas monitoring system as prescribed, the form of handling according to the provisions of the law on handling of violations shall be applied. administrative violations in the field of metrology.”

Thus, for violations of regulations on automatic and continuous monitoring of wastewater, dust and industrial emissions, they will be administratively sanctioned according to the above provisions.

Accordingly, the act of failing to install an automatic and continuous monitoring system for wastewater in Vietnam on time will be subject to an administrative fine of from VND 50,000,000 to VND 60,000,000.

5. Penalties for violations of automatic and continuous monitoring of water quality and ambient air quality and use of automatic monitoring results to provide and disclose information to the community after:

a) A fine ranging from VND 30,000,000 to VND 50,000,000 shall be imposed for failing to submit a written report to a competent state agency according to regulations on meeting technical requirements on environmental monitoring. before disclosing information to the community;

b) A fine ranging from VND 60,000,000 to VND 80,000,000 shall be imposed for using automatic and continuous monitoring devices that fail to meet technical requirements, fail to ensure the installation location, management personnel, etc. To manage the operation of water quality and ambient air quality monitoring stations in accordance with regulations to monitor and publish information on environmental quality to the community;

c) A fine ranging from VND 80,000,000 to VND 100,000,000 shall be imposed for failing to fully comply with requirements on management and operation of automatic and continuous monitoring stations for water quality and ambient air quality. regulate and use automatic monitoring results to provide and disclose information to the community;

d) A fine ranging from VND 100,000,000 to VND 120,000,000 shall be imposed for maintaining the publication of information on environmental quality from automatic and continuous monitoring results without actual monitoring equipment. or the equipment is not working at the monitoring point.”

Accordingly, for acts of using automatic and continuous monitoring devices for water quality and ambient air quality that do not meet technical requirements, an administrative fine of from VND 60,000,000 to VND 80,000 will be imposed. 000 dong.

Pursuant to Clause 6, Article 16 of Decree 45/2022/ND-CP stipulates as follows:

“Article 16. Violations against regulations on environmental monitoring and supervision

6. A fine ranging from VND 60,000,000 to VND 80,000,000 shall be imposed for failing to arrange a safe working floor at the sampling location for waste water, dust, exhaust gas, or exhaust gas sampling hole as prescribed; "

Accordingly, the act of failing to arrange a safe working floor at the sampling location for waste water, dust, exhaust gas, and exhaust gas sampling hole will be administratively sanctioned from VND 60,000,000 to VND 80,000,000.

How much fine will the fines for coordinating with units that do not have certificates of eligibility for environmental monitoring to carry out environmental monitoring?

Pursuant to Clause 7, Article 16 of Decree 45/2022/ND-CP stipulates as follows:

“Article 16. Violations against regulations on environmental monitoring and supervision

7. A fine ranging from VND 100,000,000 to VND 120,000,000 shall be imposed for cooperating with an entity that does not have a certificate of eligibility to provide environmental monitoring services within the scope of being granted the certificate to perform environmental monitoring and supervision.”

Thus, an administrative fine of between VND 100,000,000 and 200,000,000 will be imposed for the act of coordinating with an entity that does not have a certificate of eligibility for environmental monitoring activities to carry out environmental monitoring.

Note, the level of administrative sanction according to the above provisions applies only to violators, in case organizations violate, the administrative sanction will be twice that of individuals.

Decree 45/2022/ND-CP will take effect from August 25, 2022.
