Pursuant to Clause 1, Article 8 of Decree 20/2021/ND-CP stipulating as follows:
Procedures for implementation, revision and suspension of benefiting from monthly social benefits and monthly care financing
1. Procedures for implementation, revision and suspension of benefiting from monthly social benefits and monthly care, nurture financing are as follow:
a) Beneficiaries, their guardians or relevant organizations, individuals shall prepare application according to Article 7 hereof and submit to People’s Committees of communes, wards, townlets where they live (hereinafter referred to as “People’s Committees of communes”). Following documents must be submitted along submission of application to enable receiving officials to compare information:
- Household registration book of beneficiaries of written confirmation of police authorities of communes, wards, townlets; ID Cards of Citizen Identity Cards;
- Birth certificates of children in case of considering social benefits for children, poor single parents, individuals with disabilities and raising children;
- Written confirmation of HIV infection of competent medical agencies for cases of HIV infection;
- Written confirmation of pregnancy of competent medical agencies for cases of pregnant individuals with disabilities;
- Written confirmation of disabilities for cases of individuals with disabilities.
However, according to Clause 6, Article 13 of Decree 104/2022/ND-CP stipulating as follows:

6. Replace the phrase "the household registration book of the entity or the written certification of the police of the commune, ward or township" at Point a, Clause 1, Article 8 of Decree No. 20/2021/ND-CP of March 15, 2021 stipulating the social assistance policy for beneficiaries of social protection into "certificate of information on residence or notice of personal identification number and citizen information in the National Population Database".
According to that, Decree 104/2022/ND-CP has replaced the phrase "the household registration book of the entity or the written certification of the police of the commune, ward or township" into "certificate of information on residence or notice of personal identification number and citizen information in the National Population Database".
Thus, from January 1, 2023, people with disabilities can use the certificate of information on residence or notice of personal identification number and citizen information to present when revising monthly social benefits instead of the household registration book.
In addition to the monthly social benefits, what other policies do persons with disabilities in Vietnam receive?
Pursuant to Article 5 of the 2010 Law on Persons with Disabilities in Vietnam stipulating State policies towards persons with disabilities as follows:
- Annually, the State shall allocate budget funds for the implementation of policies on persons with disabilities.
- Prevention and minimization of congenital disabilities, disabilities caused by injury or disease and other dangers of disability.
- Social relief; support for persons with disabilities in healthcare, education, vocational training, employment, culture, sports, entertainment, access to public facilities and information technology, participation in transport; prioritized implementation of social relief policies and support for children and elderly persons with disabilities.
- Incorporation of policies on persons with disabilities into socio-economic development policies.
- Creation of conditions for persons with disabilities to have orthopedic operations and functional rehabilitation; to surmount difficulties, live independently and integrate into the community.
- Training and retraining of counselors and caretakers for persons with disabilities.
- Encouragement of assistance activities for persons with disabilities.
- Creation of conditions for the operation of organizations of persons with disabilities and organizations for persons with disabilities.
- Commendation of agencies, organizations and individuals that make achievements and contributions in assisting persons with disabilities.
- Strict punishment of agencies, organizations or individuals that violate this Law and relevant laws.
What are the rights and obligations of person with disabilities in Vietnam?
Pursuant to Article 4 of the 2010 Law on Persons with Disabilities in Vietnam, the rights and obligations of persons with disabilities are as follows:
- Persons with disabilities are guaranteed the following rights:
+ To participate on an equal basis in social activities;
+ To live independently and integrate into the community;
+ To enjoy exemption from or reduction of certain contributions to social activities;
+ To be provided with healthcare, functional rehabilitation, education, vocational training, employment, legal assistance, access to public facilities, means of transport, information technology and cultural, sports, tourist and other services suitable to their forms and degrees of disability;
+ Other rights provided by law.
- Persons with disabilities shall perform civic obligations under law.
