What are the details of guidelines for organization of determination of the official rank ratio in Vietnam under Circular 04?
Pursuant to Article 4 of Circular 13/2022/TT-BNV, as amended by Clause 3, Article 1 of Circular 04/2024/TT-BNV, the organization of determination of the official rank ratio in Vietnam is as follows:
- Ministers, heads of ministerial agencies, heads of government agencies, heads of organizations established by the Government of Vietnam, the Prime Minister of Vietnam, that are not public service providers, Chairmen of the Provincial People's Committee, cities under central authority are responsible for:
+ Implementing the determination of the structure rank of each administrative agency, organization under the management authority, ensuring it does not exceed the ratio prescribed in Circular 04/2024/TT-BNV.
In case the agency or organization has an actual official rank ratio higher than the prescribed ratio in this Circular, recruitment and promotion to the official rank that has exceeded will not be conducted.
+ Compiling and reporting the results of determining the official rank structure of each administrative agency, organization under management authority according to Appendices Nos. 1, 2, and 3 issued with Circular 04/2024/TT-BNV and the position scheme approved by the competent authority to the Ministry of Home Affairs for management according to legal regulations.
- Heads of competent agencies of the Communist Party, the Vietnam Fatherland Front, and socio-political organizations decide the application of this Circular to determine the official rank structure in administrative agencies and organizations under their management authority.
- Remove the phrase "according to each specialization" in Clause 1, Article 3 of Circular 13/2022/TT-BNV.

Pursuant to Clause 2, Article 1 of Circular 04/2024/TT-BNV, the guidelines for determining the official rank ratio of agencies, organizations, units under and directly affiliated to ministries, ministerial agencies in Vietnam are as follows:
- For department-level organizations and equivalents under and directly affiliated to ministries, ministerial agencies:
+ Senior experts and equivalents: Maximum 40%;
+ Principal experts and equivalents: Maximum 40%;
+ Experts and equivalents, assistants and equivalents, clerks and equivalents: Remaining percentage rates.
- For organizations under and directly affiliated to general departments:
+ For department-level organizations and equivalents under general departments:
+ Senior experts and equivalents: Maximum 30%;
+ Principal experts and equivalents: Maximum 50%;
+ Experts and equivalents, assistants and equivalents, clerks and equivalents: Remaining percentage rates.
- For organizations directly under general departments organized locally according to sectoral authorities:
+ Principal experts and equivalents: Maximum 40%;
+ Experts and equivalents, assistants and equivalents, clerks and equivalents: Remaining percentage rates.
Procedures for determining the official rank structure in Vietnam
Pursuant to Article 3 of Circular 13/2022/TT-BNV, the procedures are as follows:
Procedures for Determining the Official Rank Structure
1. The head of the agency using officials bases on Clause 1, Article 2 of this Circular and the list of job positions and the number of official staff allocated according to each job position in the agency or organization to determine the percentage (%) of officials holding the official ranks according to each specialization in the agency or organization, report to the competent authority for approval.
2. The head of the agency managing officials approves the official rank structure in accordance with the complexity of the job based on the job position, nature, characteristics, scale of activities of the agency using officials.
3. The personnel organization department of the agency, organization, unit is responsible for advising and assisting the head in determining the number of official ranks and the official rank structure of the agency, organization, unit to submit to the competent authority for consideration and decision.
The procedures for determining the official rank structure are as follows:

Pursuant to the provisions of Article 3 of Circular 04/2024/TT-BNV:
Enforcement Effect
1. This Circular takes effect from August 15, 2024.
2. During the implementation process, should there be any difficulties, please report to the Ministry of Home Affairs for guidance and resolution./.
Circular 04/2024/TT-BNV takes effect in Vietnam from August 15, 2024.
