How many methods can the procedures for birth registration with foreign elements in Vietnam be carried out?
Pursuant to subsection 1, Section A, Part II, Administrative procedures promulgated together with Decision No. 528/QD-BTP in 2023, there are three methods of the procedures for birth registration with foreign elements in Vietnam as follows:
- Persons who request birth registration directly perform or authorize others to submit dossiers directly at the Single-window section/Public Administration Center of the district-level People's Committee.
- Or send the application through the postal system
- Or apply online on the National Public Service Portal (https://dichvucong.gov.vn) or the Provincial Public Service Portal (https://dichvucong.---.gov.vn).

What are the procedures for birth registration with foreign elements at district level applied from April 2023?
Pursuant to subsection 1, Section A, Part II, Administrative procedures promulgated together with Decision No. 528/QD-BTP in 2023 as follows:
- If you choose to submit the application directly, the person requesting birth registration shall submit the application for birth registration at the Single-window section/Public Administration Center of the competent district-level People's Committee; pay fees if they are required to pay birth registration fees; pay the fee for issuance of a copy of the birth certificate if a copy of the birth certificate is requested.
- If you choose to submit an application online, those who require birth registration can access the National Public Service Portal or the Provincial Public Service Portal, register an account (if they do not have an account), authenticate Users follow the instructions, log in to the system, properly identify the competent district-level People's Committee.
Persons requesting online birth registration shall provide information in an interactive electronic form for birth registration (provided on the Public Service Portal), attaching copies or electronic copies of papers and documents according to the law; pay fees and charges through the online payment function or by other methods as prescribed by law, complete the application.
- The dossier-receiving officer at the Single-window section is responsible for checking the accuracy, completeness, consistency and validity of the dossier.
(i) If the application is complete and valid, the application shall be received; If the application is received after 15:00, an appointment slip will be issued and the results will be returned to the requester in the next working day (if the requester chooses the form of direct application) or immediately send an appointment slip or send an appointment text message via mobile phone to the requester (if the requester chooses to submit the application online); transfer the dossier to civil status civil servants for processing.
After receiving the dossiers in the form of direct submission, the dossier-receiving officers at the single-window section will digitize (copy, convert into electronic documents on the information system, database) and digitally sign documents and records for handling administrative procedures that have been digitized according to regulations.
(ii) In case the dossier is incomplete or invalid, a notice shall be sent to the requester for supplementation or completion of the dossier, clearly stating the types of papers and contents to be supplemented so that the requester can supplement and complete the dossier. After the records are added, repeat step (i);
(iii) In case the person requesting birth registration cannot supplement or complete the application, report it to the head of the one-stop shop for a notice of refusal to handle the birth registration request.
- Civil status civil servants verify dossiers (verify the consistency and validity of information in dossiers, papers and documents submitted, presented or attached by requesters).
+ In case the dossier needs to be supplemented, completed or is not eligible for settlement and must be rejected, a notice of the status of the application should be sent to the Single-window section to notify the applicant - repeat step ( ii) or (iii);
+ In case it is necessary to check, verify, clarify or due to other reasons, the result cannot be returned on time, the civil status officer shall make an apology slip and reschedule the result return date, in which: clearly state the reason for the delay in returning the results and the appointment time to return the results, transfer the Single-window section to pay the requester (if the requester chooses to submit the application directly), or send an apology note and reschedule the return date by email or text message via mobile phone to the requester (if the requester chooses to submit the application online).
+ If the application is found to be complete, valid and in accordance with regulations, in case the application for birth registration is received directly, the civil status officer shall record it in the birth registration book. update birth registration information on the shared electronic civil status registration and management software, officially save and transfer information to the National Database on Population to get the Personal Identification Number.
In case of receiving the application for birth registration online, the civil status officer shall return the electronic birth certificate form with complete information to the requester via email or digital device.
The requester is responsible for checking the accuracy and completeness of the information on the electronic birth certificate form and certifying it (maximum one day).
If the requester for confirmation of the agreed and complete information or has no response after the request time limit, the civil status officer shall record the contents in the birth registration book and update the information. Register your birth and officially save it on the shared electronic civil status management and registration software. In case parents choose Vietnamese nationality for their children, they shall transfer information to the National Population Database to get their Personal Identification Numbers.
- After the National Population Database returns the Personal Identification Number, the civil status officer prints the Birth Certificate, submits it to the Leader of the People's Committee for signature, and sends it to the Single-window section to return the results to the requester.
- Persons who request birth registration check the information on the birth certificate, in the birth registration book and sign in the birth registration book, and receive the birth certificate.
What are the documents for birth registration with foreign elements at the district-level People's Committee?
Pursuant to subsection 1, Section A, Part II, Administrative procedures promulgated together with Decision No. 528/QD-BTP in 2023 as follows:
- A birth registration declaration form (if the requester chooses to submit the application in person);
- Interactive electronic birth registration form (by the requester providing information according to the instructions on the Public Service Portal, if the requester chooses to submit the application in the online form);
- Persons requesting birth registration shall submit/present (in person) or upload (online form) the following documents:
(1) Documents to be submitted:
- Birth certificate.
If the birth certificate is not available, it shall be replaced with: the witness's document certifying the birth; if there is no witness's document, the written commitment about the birth shall be replaced;
In case the child is born in a foreign country, the birth certificate or other paper issued by a foreign competent authority certifying the child's birth abroad and the mother-child relationship;
+ In case the father or mother or both parents are foreigners, the written agreement of the parents on the selection of nationality for the child must be submitted. In case a parent chooses a foreign nationality for their child, in addition to the written agreement on nationality selection, there must also be certification by the competent authority of the country of which the child is selected to hold the nationality that the child's nationality is in accordance with the laws of that country;
+ Power of attorney (certified) as prescribed by law in case of authorization to carry out birth registration. In case the person going to register the birth of a child is a grandfather, grandmother or other relative, a written authorization from the child's parents is not required, but must agree with the child's parents on the content of birth registration;
(2) Documents to be presented:
- Passport or ID card or citizen identification card or other papers with photos and personal information issued by a competent authority, valid for use to prove the identity of the person requesting birth registration. In case the personal information in these documents is already in the National Population Database, the Electronic Civil Registry Database, and is automatically filled in by the system, it is not required to upload it (in the online form);
- Valuable papers to prove information about residence in case the civil status registration agency is unable to extract information about the citizen's place of residence. In case the information on documents proving residence has been extracted from the National Population Database by these methods, the requester is not required to present (in direct form) or download up (in online form).
- Marriage certificate if parents have registered their marriage. In case information about the marriage of parents is already available in the electronic civil status database or the national population database, it is not required to present (in direct form) or upload (according to online form);
- Papers proving the children's lawful entry into Vietnam (such as passports, papers with international travel value, stamped entry confirmation of the immigration authorities) and documents certification by a competent police agency that the child is residing in Vietnam in case the child is born abroad and has a parent who is a Vietnamese citizen or both parents who are Vietnamese citizens, has not yet registered his birth in a foreign country, and resides in Vietnam.
In case the application is sent via the postal system, it must be enclosed with certified copies of the documents to be presented above.
