Guidelines for the procedure for issuing licences to transport dangerous goods of class 1, class 2, class 3, class 4 and class 9 at district level in Vietnam in 2024

Based on Subsection 3, Part C, Section II of Administrative Procedures issued together with Decision 3384/QD-BCA-C07 2024 guiding the procedure to issue a permit for transporting hazardous goods of classes 1, 2, 3, 4, and 9 by road motor vehicles, and on inland waterways (excluding industrial explosives) as follows:

- Step 1: Individuals and organizations prepare the dossier as required by law.

- Step 2: Individuals and organizations submit the dossier to the District Police affiliated with the Provincial/City Police under the central government.

- Step 3: The receiving officer checks the validity and components of the dossier (the documents in the dossier sent to the police agency are the original or authenticated copies or copies attached to the original for comparison in case of direct submission or through public postal service; original or electronic authenticated copies in case of online submission via the national public service portal, Ministry of Public Security's public service portal).

+ If the dossier is valid and complete, issue a receipt for processing administrative procedures for fire prevention and fighting, and give one copy to the applicant and keep one copy on file, or send a receipt notification via email or phone message to the applicant;

+ If the dossier is incomplete or invalid, return it for completion, and record the information in a supplementary dossier guidance sheet, giving one copy to the applicant and keeping one copy on file, or record the guidance content for dossier completion to notify via email or phone message to the applicant.

- Step 4: Based on the appointment date on the receipt of administrative procedures for fire prevention and fighting or the notification via email or phone message, individuals and organizations come to the dossier submission place to receive the result directly or through public postal service or receive electronic results on the previously used public service account.

- Method of Implementation:

+ Direct: Submit the dossier directly at the One-Stop Shop of the District Police affiliated with the Provincial/City Police under the central government.

+ Public Postal Service: Submit the dossier through the public postal service.

+ Online: Submit the dossier at the National Public Service Portal, Ministry of Public Security's Public Service Portal.

- Fees and Charges: None.

- Processing Time: 5 working days from the date of receipt of complete and valid dossier.

- Handling Authority: District Police affiliated with the Provincial/City Police under the central government.

What are the requirements for motor vehicles carrying dangerous goods in Vietnam?

According to Article 10 Decree 34/2024/ND-CP, stipulating the requirements for motor vehicles carrying dangerous goods in Vietnam:

(1) Vehicles for transport must meet the conditions for road use as required by law. Specialized equipment for transporting hazardous goods must meet national standards or technical regulations or as specified by the industry management authority.

(2) Vehicles transporting hazardous goods must bear hazard labels. If a vehicle carries multiple types of hazardous goods, it must bear all relevant hazard labels. The labels must be affixed on both sides, front, and rear of the vehicle in easily visible and identifiable positions.

(3) Vehicles transporting hazardous goods, after unloading all hazardous goods, if they do not continue to transport such goods, must be cleaned, and the hazard labels removed or obliterated. The transport unit and vehicle operator are responsible for cleaning and removing the hazard labels when not continuing to transport the hazardous goods.

Application for issuing licences to transport dangerous goods of class 1, class 2, class 3, class 4 and class 9 at district level in Vietnam

Based on Subsection 3, Part C, Section II of Administrative Procedures issued with Decision 3384/QD-BCA-C07 2024, stipulating the components and quantities of the dossier for issuing a permit for transporting hazardous goods of classes 1, 2, 3, 4, and 9 by road motor vehicles, and on inland waterways (excluding industrial explosives) at the district level as follows:

- Proposal for issuing a dangerous goods transport licence according to the form specified in Appendix IV of Decree 34/2024/ND-CP dated March 31, 2024 of the Government of Vietnam, original copy.

Quantity: 01.

- List of vehicles participating in the transport with valid inspection certificates as required, original, electronic copy, or electronic authenticated copy.

Quantity: 01.

- List of drivers of transport vehicles carrying hazardous goods (including: Full name; identity card number, or citizen identification card number, or passport number; driving license number, and class of the license (for drivers); certificate of competence number, and class (for ship crew); and list of escorts in case of mandatory escort (including: Full name, identity card number, or citizen identification card number, or passport number) attached with a copy of the certificate of completion of safety training as required, original, electronic copy, or electronic authenticated copy.

Quantity: 01.

- Certificate of completion of the training program for drivers of road motor vehicles for transporting hazardous goods;

Copy or electronic copy of the special professional certificate of the ship crew for transporting hazardous goods on inland waterways, original, electronic copy, or electronic authenticated copy.

Quantity: 01.

- Transportation plan for hazardous goods of the transporting unit according to the form specified in Appendix V Decree 34/2024/ND-CP (including at least the following contents: Vehicle registration number; full name of the vehicle operator; type of goods; quantity; route, transportation time; emergency response measures in case of fire, explosion);

Oil spill contingency plan (applicable only to oil transportation on inland waterways), original, electronic copy, or electronic authenticated copy, quantity: 01.
