Procedures for Renewing the Certificate of Land Use Rights, Home Ownership, and Other Assets Attached to Land at the Provincial Level

Based on subsection 7, Section 1, Appendix 2 issued with Decision 1085/QD-BTNMT in 2023 guiding the procedures for directly renewing the Certificate of Land Use Rights, Home Ownership, and other assets attached to land in cases where the Land Registration Office has been established, as follows:

- Land users submit the application at the Land Registration Office or its branches, or at reception agencies as prescribed by the provincial People's Committee, or at locations based on demand in localities where the provincial People's Committee has issued regulations on receiving, forwarding applications, handling, and returning results according to demand regarding location.

Families, individuals, and community residential units submit applications at the communal People's Committee if desired.

In cases where the application is incomplete or invalid, within a maximum of 3 days, the receiving and processing agency must notify and guide the applicant to supplement and complete the application according to regulations.

- The receiving agency is responsible for fully recording information into the application reception and results return registry and handing over the application reception and results return receipt to the applicant; transferring the application to the Land Registration Office or its branches.

- The Land Registration Office or its branches are responsible for:+ Checking the application, confirming the reason for the renewal of the Certificate in the application form;+ Issuing the Certificate of Land Use Rights, Home Ownership, and Other Assets Attached to Land;+ Updating, revising cadastral records, and the land database.

- The Land Registration Office or its branches will hand over the renewed Certificate to the applicant or send it to the communal People's Committee to hand over in cases where the application is submitted at the communal level.

In cases of renewing the Certificate after cadastral mapping while the existing Certificate is mortgaged at a credit institution, the Land Registration Office or its branches must notify the list of cases undergoing Certificate renewal procedures to the credit institution receiving the land use rights and attached assets as collateral; confirming the mortgage registration into the Certificate of Land Use Rights, Home Ownership, and Other Assets Attached to Land after being signed and renewed by the competent authority.

The procedure to hand over the renewed Certificate involves the following three parties simultaneously: the Land Registration Office or its branches, the land user, and the credit institution according to the following provisions:

- The land user signs and receives the renewed Certificate of Land Use Rights, Home Ownership, and Other Assets Attached to Land from the Land Registration Office or its branches to hand it over to the credit institution currently holding the mortgage.- The credit institution is responsible for handing over the old Certificate currently mortgaged to the Land Registration Office or its branches for management.

Documents for Renewing the Certificate of Land Use Rights, Home Ownership, and Other Assets Attached to Land at the Provincial Level

Based on subsection 7, Section 1, Appendix 2 issued with Decision 1085/QD-BTNMT in 2023 guiding the procedures for directly renewing the Certificate of Land Use Rights, Home Ownership, and other assets attached to land in cases where the Land Registration Office has been established, the following documents are required:

- An application for renewing the Certificate according to Form No. 10/DK issued with Circular 24/2014/TT-BTNMT;- The original issued Certificate;- A copy of the mortgage contract of the land use rights, assets attached to land replacing the original issued Certificate in cases of renewing the Certificate after cadastral mapping while the existing Certificate is mortgaged at a credit institution.
