What is a seal of technical safety and environmental protection inspection of motor vehicles in Vietnam?

According to Clause 3, Article 3 of Circular 16/2021/TT-BGTVT, the seal of technical safety and environmental protection inspection of motor vehicles is defined as follows:

The seal of technical safety and environmental protection inspection of motor vehicles (referred to as the seal of inspection) is a symbol issued to a motor vehicle that has been granted a Certificate of Inspection and is permitted to participate in road traffic within the territory of the Socialist Republic of Vietnam and other countries with which Vietnam has signed a mutual recognition agreement on the Certificate of Inspection.

According to Clause 5, Article 9 of Circular 16/2021/TT-BGTVT (amended by Point c, Clause 4, Article 1 of Circular 2/2023/TT-BGTVT), the regulations are as follows:

5. If the Certificate of Inspection or seal of inspection is lost or damaged, the vehicle owner must take the vehicle for re-inspection to be reissued a Certificate of Inspection and seal of inspection, except in the following cases:

a) If the initial Certificate of Inspection or initial seal of inspection of motor vehicles exempt from inspection is lost, the vehicle owner or the authorized person, as regulated by law, within 07 working days from the date of issuance of the initial Certificate of Inspection or initial seal of inspection, must report it to the inspection unit using the form in Appendix I attached to this Circular to be reissued a Certificate of Inspection and seal of inspection once only (The vehicle owner does not have to bring the vehicle to the inspection unit);

b) If the Certificate of Inspection or seal of inspection of motor vehicles exempt from initial inspection is damaged or has discrepancies with the vehicle information, the vehicle owner must bring the issued Certificate of Inspection and seal of inspection to the inspection unit and report it using the form in Appendix I attached to this Circular for the inspection unit to review, verify, and reissue the Certificate of Inspection or seal of inspection (The vehicle owner does not have to bring the vehicle to the inspection unit).

6. If it is discovered that the documents provided by the vehicle owner have been falsified or altered; the issued Certificate of Inspection and seal of inspection do not match the inspected motor vehicle, the inspection unit must revoke the issued Certificate of Inspection and seal of inspection (if still valid) and report to the Vietnam Register.

Thus, according to the above regulations, if the seal of inspection of motor vehicles is lost, the vehicle owner must take the vehicle for re-inspection to be reissued an seal of inspection, except in the following cases:

- If the initial seal of inspection of motor vehicles exempt from inspection is lost, within 07 working days from the date of issuance of the initial seal of inspection, the vehicle owner or the authorized person, as regulated by law, must report it to the inspection unit using the form in Appendix I attached to Circular 2/2023/TT-BGTVT to be reissued the seal of inspection once only (The vehicle owner does not have to bring the vehicle to the inspection unit).

- If the seal of inspection of motor vehicles exempt from initial inspection is damaged or has discrepancies with the vehicle information, the vehicle owner must bring the issued seal of inspection to the inspection unit and report it using the form in Appendix I attached to Circular 2/2023/TT-BGTVT for the inspection unit to review, verify, and reissue the seal of inspection (The vehicle owner does not have to bring the vehicle to the inspection unit).

According to Clause 7, Article 9 of Circular 16/2021/TT-BGTVT, the regulations are as follows:

7. The Certificate of Inspection and seal of inspection expire when:

a) A new Certificate of Inspection and seal of inspection have been issued to the motor vehicle;

b) There is a loss report from the vehicle owner to the inspection unit;

c) There is a recall notice from the inspection units;

d) The motor vehicle has been in an accident to the extent that it no longer meets safety and environmental protection regulations;

dd) The inspection unit confirms discrepancies between the technical specifications on the Certificate of Inspection and the actual technical specifications of the motor vehicle.

Thus, according to the above regulations, the seal of inspection of motor vehicles expires when:

- A new seal of inspection has been issued to the motor vehicle.- There is a loss report from the vehicle owner to the inspection unit.- There is a recall notice from the inspection units.- The motor vehicle has been in an accident to the extent that it no longer meets safety and environmental protection regulations.
