Basis, requirements for searching, and collecting martyr's remains in Vietnam

Based on the provisions of Clause 1, Article 15 of Circular 80/2022/TT-BQP, the regulations are as follows:

1. Basis for searching and collecting martyr's remains

Based on the approved general plan, each specific batch or case must have a detailed plan, approved by the Provincial Military Command or the political agency of the unit assigned the task of searching and collecting martyr's remains.

According to the above regulation, the search and collection of martyr's remains are based on the approved general plan.

At the same time, the requirement for searching and collecting martyr's remains is based on Clause 2, Article 15 of Circular 80/2022/TT-BQP, which provides as follows:

a) Assign specific tasks to forces and departments; prepare sufficient facilities, equipment, and means; coordinate closely with relevant agencies, units, localities, and ensure absolute safety for the forces during the search and collection of martyr's remains;

b) Organize the search and collection of martyr's remains strictly, openly, specifically, meticulously, carefully, and safely, suitable to the customs of each locality; after the search and collection, coordinate with relevant agencies, units, and localities to draw up a conclusion report and a collection dossier of martyr's graves.

Procedures for searching and collecting martyr's remains in Vietnam

Based on the provisions of Clause 3, Article 15 of Circular 80/2022/TT-BQP, the regulations are as follows:

3. Procedures for searching and collecting martyr's remains

a) Identify the location for the search and collection on the ground;

b) Organize mine detection and clearing, marking safe positions;

c) Cross-reference the list of martyrs, and the unit’s grave diagram (if any) with the position of each grave on the ground to determine the name and hometown of the martyr;

d) Draw the plan of each grave and grave area before searching and collecting martyr's remains;

dd) Dig, search, and collect martyr's remains (when discovering remains and artifacts, take photos to document and archive);

e) Count the number and quality of remains and attached artifacts discovered;

g) Pack and preserve, number for management, and record the name (if the martyr’s remains have information);

h) Prepare a dossier for searching and collecting martyr's remains;

i) Level the ground and handover the site to the organization or individual;

k) Transport the remains and artifacts of the martyrs to the preservation location;

l) Report as prescribed.

The search and collection of martyr's remains follow the procedures mentioned above.

Handling the results of searching and collecting martyr's remains for collective graves

Based on the provisions of Article 16 of Circular 80/2022/TT-BQP, the regulations are as follows:

Handling the results of searching and collecting martyr's remains

1. For individual martyr's grave remains

After searching and collecting the martyr's remains, make a dossier as guided in Article 17 of this Circular; in cases where information has not been identified or is lacking, the unit performing the search and collection task cooperates with the provincial Department of Labor, War Invalids, and Social Affairs to collect samples for DNA testing to identify the remains of martyrs.

2. For collective martyr’s grave remains

a) When searching and collecting without accurately determining the number of martyr remains, their identities, and artifacts of each martyr, the collected martyr remains shall be buried in a collective grave (do not separate individual remains and name each martyr if there is no basis for conclusion);

b) Based on the list of martyrs provided by units, localities, and veterans who once fought in the area (if any) and the management dossiers, the Department of Policy, General Department of Politics cooperates with the Department for Persons with Meritorious Service of the Ministry of Labor, War Invalids, and Social Affairs to appraise and agree on the list for engraving the names of martyrs on the common tombstone.

3. In cases where there are artifacts but no basis to confirm the martyr’s information, the search and collection unit makes a collection dossier as prescribed and reports to the provincial Military Command or the commanding unit assigned the task of searching and collecting the martyr's remains to coordinate with relevant agencies and units for verification and conclusion; if there is sufficient basis to identify a martyr's grave and it's the first collection, agree and hand over to the Labor, War Invalids, and Social Affairs sector for burial as prescribed. In cases where the martyr's information and grave cannot be verified and concluded, report to the Steering Committee at all levels for consideration and resolution under their authority.

According to the above regulation, handling the results of searching and collecting martyr’s remains for collective grave remains is as follows:

- The collected martyr's remains shall be buried in a collective grave when the search and collection do not accurately determine the number of martyr remains, their identities, and artifacts of each martyr.

Note: Do not separate individual remains and name each martyr if there is no basis for conclusion.

- The Department of Policy, General Department of Politics cooperates with the Department for Persons with Meritorious Service of the Ministry of Labor, War Invalids, and Social Affairs to appraise and agree on the list for engraving the names of martyrs on the common tombstone based on the list of martyrs provided by units, localities, and veterans who once fought in the area (if any) and the management dossiers.
