What does the military service health examination include?
According to the provisions at Article 7 and Article 8 of Circular 105/2023/TT-BQP, the military service health examination is conducted in two rounds: Preliminary examination and Detailed examination.
The military service health examination is carried out in 2 rounds with the following contents:
Round 1: Preliminary military service health examination:
- The commune-level health station conducts the preliminary military service health examination under the guidance and professional direction of the district-level medical center or the district-level general hospital; under the supervision of the district military command.
- Based on the plan for selecting and calling citizens for enlistment of the district military service council, the commune-level military command makes a list and calls for preliminary health examinations for citizens subject to military service health examinations in the area under management.
- The preliminary health examination includes the following contents:
+ Exploring personal and family medical history;
+ Detecting cases of insufficient physical health, deformities, disfigurements as prescribed in Section I, Section II Appendix I issued concurrently with this Circular; diseases subject to exemption from military service registration as prescribed in Section III Appendix I issued concurrently with Circular 105/2023/TT-BQ.
Round 2: Military service health examination:
- The military service health examination is conducted by the district military service health examination council as prescribed in Clause 1 Article 40Military Service Law 2015, including:
- The Chairman of the Council is the Director of the district-level Medical Center or the Director of the district-level General Hospital;
- The Vice Chairman of the Council is the Deputy Director in charge of expertise at the district-level Medical Center or Deputy Director of the district-level General Hospital;
- The Standing Member cum Secretary of the Council is the advisory officer for state management of health care at the district level;
- Members are officers and employees from agencies, units including: district-level Medical Center, district-level General Hospital (if available), district health agency, district military command health unit, and representatives of relevant units; where necessary, additional provincial-level health staff or provincial military command medical personnel may be provided as decided by the Chairman of the provincial military service council.
- Members of the Council ensure complete departments, specializations as prescribed in Clause 5 of this Article and must have a professional practice certificate or practicing license in accordance with the law on medical examination and treatment.
- Create a list of citizens for examination;
- Notify the time and place for organizing health examinations (Issue a health examination order);
- Organize health examinations with the following contents:
+ Physical examination; clinical examination by specialties: Eye, Ear-Nose-Throat, Dentistry, Internal Medicine, Neurology, Psychiatry, Surgery, Dermatology, Gynecology (for females);
+ Para-clinical examinations: Complete blood count; blood group (ABO); liver function (AST, ALT); kidney function (Urea, Creatinine); blood glucose; Hepatitis B virus (HBsAg); Hepatitis C virus (Anti-HCV); HTV; complete urinalysis (10 parameters); general abdominal ultrasound; electrocardiogram; chest X-ray; urine drug screening. The Chairman of the Council may order additional tests as required for accurate health conclusions.
Implemented in 2 rounds: Physical and clinical examinations, and Para-clinical screening, HIV and drug screening. During the physical and clinical examinations, if a citizen fails to meet any health standards as prescribed in Clause 1 Article 4 of Circular 105/2023/TT-BQP, the member directly examining will report to the Chairman for a decision to stop the examination. Blood, urine; HIV, and drug testing are only conducted for citizens who meet health standards after physical, clinical examinations, ultrasound, ECG, and chest X-ray.
Organize HIV consultation and testing as prescribed by the law on HIV/AIDS prevention and control for those who meet health standards.
Under what circumstances do citizens not have to perform military service?
According to the provisions of Clause 1 Article 41 Military Service Law 2015 supplemented by Point c Clause 1 Article 49 Civil Defense Law 2019, the following cases are temporarily deferred from conscription:
- Insufficient health to serve in the military according to the conclusion of the health examination council;
- The only laborer directly supporting relatives who are incapable of working or under working age; in families heavily damaged in terms of people and property due to accidents, natural disasters, dangerous epidemics as certified by the commune-level People's Committee.
- One child of a war invalid, a person affected by Agent Orange with a health deterioration of 61% to 80%.
- Has a brother or sister who is a non-commissioned officer or soldier serving in the military; a non-commissioned officer, soldier performing obligations to participate in the People's Police;
- People classified as migrants, resettlers within the first 3 years in particularly difficult communes under the State's socio-economic development projects as decided by the provincial-level People's Committee or higher;
- Officials and public employees, young volunteers assigned to work in areas with particularly difficult socio-economic conditions as prescribed by law;
- Currently studying at an educational institution; pursuing full-time education at a higher education institution, or full-time vocational training at a vocational institution during the duration of one training course per level of education.
- Permanent militia.
Citizens in the above-mentioned categories are temporarily deferred from conscription in 2024.
In addition, the cases specified in Clause 2 Article 41 Military Service Law 2015 are exempt from conscription in 2024, including the following subjects:
- Children of martyrs, children of rank-one invalids;
- One brother or one sister of a martyr;
- One child of a rank-two invalid; one child of a pensioner entitled to a reduction in working ability of 81% or more; one child of a person affected by Agent Orange with a reduction in working ability of 81% or more.
- Persons engaged in cipher work not being military personnel, People’s Police;
- Officials and public employees, young volunteers assigned to work in areas with particularly difficult socio-economic conditions as prescribed by law for 24 months or more.
In addition, citizens who are temporarily deferred from conscription as mentioned above, if the reason for the deferment no longer exists, will be conscripted.
Citizens in the categories eligible for deferment or exemption from conscription, if volunteering, will be considered and selected for conscription.
