How to Implement the Procedure for Approving the Content of Imported Fine Art Works and Photographic Works Under the Jurisdiction of the Department of Culture, Sports, and Tourism 2024
How to Carry Out the Procedures for Approving the Content of Imported Fine Art Works and Photographs under the Authority of the Department of Culture, Sports, and Tourism in 2024?
Based on the provisions of Part II on administrative procedures to be amended, supplemented, and abolished in the field of Fine Arts, Photography, and Exhibitions, within the management scope of the Ministry of Culture, Sports, and Tourism, as issued together with Decision 3698/QD-BVHTTDL 2023, the procedures for approving the content of imported fine art works and photographs under the authority of the Department of Culture, Sports and Tourism are as follows:
(*) Procedure sequence:
+ Local organizations and individuals requesting approval for the content of imported fine art and photographs shall send 01 dossier directly or by mail to the Department of Culture, Sports, and Tourism/Department of Culture and Sports.
+ Within 05 working days from the date of receipt of the dossier, if the dossier is incomplete and invalid, the competent authority shall issue a written notification requesting the applicant to supplement the dossier.
+ Within 07 working days from the date of receiving a complete and valid dossier, the competent authority shall issue a written response regarding the approval of the content of the imported works. In case of non-approval, the competent authority must respond in writing, stating the reasons.
The approval document for the content of the works is the basis for the applicant to carry out import procedures with customs.
(*) Method of implementation:
Submit directly or send by mail to the Department of Fine Arts, Photography, and Exhibitions or submit online via the Public Service Portal of the Department of Culture, Sports, and Tourism/Department of Culture and Sports.
(*) Components and quantity of the dossier:
+ Dossier components:
(1) Request form for Approval of the Content of Fine Art Works, Photographic Works (Appendix VI issued together with Circular 13/2023/TT-BVHTTDL dated October 30, 2023, amending and supplementing regulations related to citizen papers in several Circulars issued by the Minister of Culture, Sports, and Tourism)
(2) Photos of the imported works, specifying the material and size.
+ Dossier quantity: 01 set.
(*) Time limit for resolution:
Within 05 working days from the date of receipt of the dossier, if the dossier is incomplete and invalid, the competent authority shall issue a written notification requesting the applicant to supplement the dossier.
Within 07 working days from the date of receiving a complete and valid dossier, the competent authority shall issue a written response regarding the approval of the content of the imported works. In case of non-approval, the competent authority must respond in writing, stating the reasons.
(*) Subjects of administrative procedures (TTHC) implementation: Individuals, organizations

(*) Results of administrative procedures implementation: Approval document
(*) Fees, charges:
(1) For fine art works:
+ For the first 10 works: 300,000 VND/work/assessment.
+ For the 11th to the 49th work: 270,000 VND/work/assessment.
+ For the 50th work onwards: 240,000 VND/work/assessment, maximum not exceeding 15,000,000 VND.
(2) For photographic works:
+ For the first 10 works: 100,000 VND/work/assessment.
+ For the 11th to the 49th work: 90,000 VND/work/assessment.
+ For the 50th work onwards: 80,000 VND/work/assessment.

What is the Authority to Approve the Content of Imported Fine Art Works and Photographs?
Based on the provisions of Article 7 Circular 28/2014/TT-BVHTTDL, as amended by Clause 14, Article 1 of Circular 26/2018/TT-BVHTTDL:
Authority to approve the content of imported fine art works and photographs:
a) The Department of Fine Arts, Photography, and Exhibitions receives dossiers and approves the content of fine art works and photographs imported by organizations under central government authorities;
b) The Department of Culture, Sports, and Tourism receives dossiers and approves the content of fine art works and photographs imported by local entities.
Thus, the authority to approve the content of imported fine art works and photographs belongs to two entities as follows:
(1) The Department of Fine Arts, Photography, and Exhibitions under the Ministry of Culture, Sports, and Tourism approves works imported by organizations under central government authorities.
(2) The Department of Culture, Sports, and Tourism approves works imported by other local entities.
Which Fine Art Works and Photographs are Prohibited from Being Imported into Vietnam?
Based on the provisions of Article 6 Circular 28/2014/TT-BVHTTDL, the following fine art works and photographs are prohibited from being imported into Vietnam:
Fine art works and photographs with content:
- Inciting people to oppose the State of the Socialist Republic of Vietnam; destroying the solidarity of the people;
- Propagating, inciting violence, invasive war, hatred among nations and people of different countries; disseminating reactionary ideologies and cultures, promoting obscene lifestyles, criminal acts, social evils, superstitions, contrary to fine customs and traditions, harming health, and destroying ecological environment;
- Disclosing secrets of the Communist Party, the State, military secrets, security, economy, foreign affairs, personal privacy, and other secrets as prescribed by law;
- Distorting historical facts; denying revolutionary achievements; insulting the nation, dignitaries, national heroes; defaming, insulting the prestige of agencies, organizations, honor, and dignity of individuals;
- Not conforming to the nation's ethical, cultural, and traditional values.
Fine art works and photographs that have been decided to be suspended, banned from circulation, recalled, confiscated, destroyed, or violating legal provisions on copyright and related rights.
