How to handle teachers who violate professional ethics in Vietnam?
According to the provisions of Article 4 of the Regulation on the teaching professional's moral standards promulgated together with Decision 16/2008/QD-BGDDT of Vietnam stipulating professional ethics for teachers as follows:
“1. Show devotion to their chosen profession, develop an awareness of protecting their honor and professional conscience; have the spirit of solidarity, love and care and support for colleagues in both daily life and work activities; show compassion, generosity, tolerance, and have an amicable attitude towards students and colleagues; be willing to give help, protect legitimate rights and interests of students, colleagues and communities.
2. Be wholeheartedly devoted to assignments; comply with statutes, rules and regulations as set out by an organization, school and teaching authority.
3. Demonstrate teaching and educational equity, carry out truthful assessment of students’ competence; practice thrift and frugality, and struggle against the so-called achievement disease, corruption and extravagance.
3. Carry out criticism and self-criticism in a regular and serious manner ; increase the frequency of taking classes to improve the knowledge level and professional skills, foreign language and computer proficiency with a view to performing assigned tasks in an efficient manner as well as meet rising educational demands.”
Thus, teachers who have made objectionable videos have violated professional ethics by failing to protect the teacher's honor.
Professional ethics of teachers in Vietnam
What is the form of reprimand for violating public employees?
Pursuant to Article 16 of Decree 112/2020/ND-CP of Vietnam stipulating the application of reprimand to public employees as follows:
The form of reprimand shall be applied to acts of violation for the first time, causing less serious consequences, except for the violations specified in Clause 3, Article 17 of this Decree, in one of the following cases:
1. Failure to comply with professional processes, regulations, professional ethics and codes of conduct while performing professional activities, which have been warned in writing by competent authorities;
2. Violating the law on: performing the duties and responsibilities of public employees; labor discipline; regulations, rules and working regulations of public non-business units which have been reminded in writing by competent authorities;
3. Taking advantage of the working position for self-seeking purposes; having a bossy, authoritarian attitude or causing difficulties or troubles to people in the course of performing assigned tasks and tasks; certify or issue legal documents to ineligible persons; offend the honor, dignity and reputation of others while performing professional activities;
4. Failure to comply with the decision on assignment of work of the competent authority; failure to perform assigned duties without a valid reason; causing disunity in the unit;
5. Violating the provisions of law on: crime prevention and combat; Prevention of social evils; safety and order of society; Anti-corruption; practice thrift, fight waste;
6. Violating regulations of law on protection of state secrets;
7. Violating the provisions of law on complaints and denunciations;
8. Violating the provisions of law on: investment, construction; land, natural resources and environment; finance, accounting, banking; management and use of public property in the course of professional activities;
9. Violation of the law on: domestic violence prevention and control; population, marriage and family; gender equality; Social Security; other provisions of law relating to public employees.
What is the form of warning for violating public employees?
Pursuant to Article 17 of Decree 112/2020/ND-CP of Vietnam stipulating the application of warning to public employees as follows:
A warning shall be applied to a public employee who commits violations in one of the following cases:
1. Having been disciplined in the form of reprimand for the violations specified in Article 16 of this Decree, but recidivism;
2. Committing an act of violation for the first time, causing serious consequences in one of the cases specified in Article 16 of this Decree;
3. Committing an act of violation for the first time, causing less serious consequences in one of the following cases:
a) Managerial public employees fail to properly perform their responsibilities, allowing public employees under their management to violate the law, causing serious consequences while performing professional activities;
b) The management public employee fails to complete the management and administration tasks as assigned without a legitimate reason.
Thus, for teachers who violate professional ethics, it is necessary to consider the level of violation to apply discipline to this teacher.
In case this teacher violates professional ethics but does not cause serious consequences and has been warned in writing by a competent person, he/she will be reprimanded.
In case this teacher violates professional ethics and repeats it, or for the first time, but causes serious consequences, he/she will be subject to the disciplinary form of warning.
In addition, this teacher may be subject to the highest disciplinary measure, which is forced to resign when deeming that the act of filming objectionable videos causes particularly serious consequences (Article 19 of this Decree).
