Who are the 03 subjects entitled to the convalescence and health rehabilitation allowance after sickness, maternity leave, occupational accident or occupational disease in Vietnam?

Pursuant to the provisions of the 2014 Law on Social Insurance in Vietnam, employees are entitled to convalescence and health rehabilitation allowance after sickness, maternity leave, occupational accident or occupational disease in the following cases:

- Employees who have taken sick leave for a full year in a year as prescribed, including employees suffering from diseases on the List of diseases requiring long-term treatment promulgated by the Ministry of Health, within the first 30 days of returning to work without recovery.

- Female employees after the maternity leave period, within the first 30 days of returning to work, but their health has not yet recovered.

- Employees participating in compulsory occupational accident and occupational disease insurance after stabilizing treatment for injuries caused by occupational accidents or diseases caused by occupational diseases but their health has not yet recovered.

Thus, if the employee falls into the above cases, the employee is considered by the employer and makes a dossier of request for settlement of sickness, maternity, convalescence and health rehabilitation allowance to the social insurance agency.

Pursuant to Decision No. 896/QD-BHXH in 2021 on the list of online public services for administrative procedures under the jurisdiction of Vietnam Social Security.

Procedures for settlement of convalescence and health rehabilitation allowance after sickness, maternity leave, occupational accident or occupational disease shall comply with the provisions of subsection 3, Section III of the Appendix issued together with Decision No. 896/QD-BHXH in 2021. To be specific:

(1) Order of implementation

Step 1. Prepare and submit application

- The head of the employer shall coordinate with the Executive Committee of the grassroots Trade Union based on the dossiers of entitlement to sickness, maternity leave, occupational accident or occupational disease benefits, the employee's health status and regulations of the policy to decide regulations on:

+ Number of employees;

+ Number of days of convalescence to recover from sickness, maternity leave, occupational accident or occupational disease according to regulations.

(In case the grassroots trade union has not been established, the employer shall decide).

- Make a list of requests for settlement of benefits for sickness, maternity, convalescence and rehabilitation (Form No. 01B-HSB).

- Submit the application to the social insurance agency where the employer pays the social insurance premium.

Step 2. The social insurance agency receives the dossier and settles it according to regulations.

Step 3. Get the settlement result

Pursuant to subsection 3, Section III of the Appendix issued together with Decision No. 896/QD-BHXH in 2021, the method of carrying out the procedures for settlement of convalescence and health rehabilitation allowance after sickness, maternity leave, occupational accident or occupational disease is defined as follows:

Submit the application

The employer shall submit the application in one of the following forms:

- Through electronic transactions: the employer makes an electronic profile, digitally signs it and sends it to the Public Service Portal of the Vietnam Social Security, the National Public Service Portal or through the I-VAN organization; In case the paper application is not converted to electronic format, the paper application shall be sent to the social insurance agency by post.

- Via Postal.

- Directly at the social insurance agency.

Receive results:

(1) Employer:

- Receive the List of settlement of entitlement to sickness, maternity, convalescence and health rehabilitation allowance (Form No. C70a-HD) in the registered form (directly at the social insurance agency or by post or by electronic transaction).

- Receive the allowance from the social insurance agency and transfer it to the account of the unit to pay to employees who register to receive cash at the employer.

(2) Employees receive benefits in one of the following forms:

- Through the employer

- Through personal accounts;

- Directly receive at the social insurance agency in case it has not been received at the unit but the unit has transferred the funds to the social insurance agency.

In case of authorizing another person to receive on behalf of others, comply with the provisions of the Public Service "Authorization to receive social insurance and unemployment benefits on behalf of others" or the original of the authorization contract as prescribed by law.
