How much is the fee for issuing a citizen identity card in Vietnam in 2023?
According to the provisions of Article 4 of Circular 59/2019/TT-BTC on the fee for issuance of citizen identification as follows:
Fees
1. Citizens change from a 9-digit ID card, a 12-digit ID card to a citizen identity card: VND 30,000/Citizen identity card.
2. Change the citizen's identity card when it is damaged and cannot be used; change information about surname, middle name, first name; identity characteristics; re-determination of gender, hometown; there is an error in the information on the card; upon request: VND 50,000/Citizen identity card.
3. Re-issuance of citizen identity card when losing citizen identity card, return to Vietnamese nationality in accordance with the provisions of the Law on Vietnamese nationality: VND 70,000/citizen identity card.
Thus, the citizen identification fee rate in 2023 includes:
- VND 30,000/Citizen identity card for Citizens who change from 9-digit ID card, 12-digit ID card to issue citizen identity card.
- VND 50,000 /Citizen identity card for the replacement of the Citizen identity card when it is damaged and cannot be used; change information about surname, middle name, first name; identity characteristics; re-determination of gender, hometown; there is an error in the information on the card; when a citizen requests it
- VND 70,000/Citizen identity card for re-issuance of a citizen identity card when the citizen identity card is lost, to regain Vietnamese nationality according to the provisions of the Law on Vietnamese nationality.

What is the administrative penalty for using forged citizen identity cards in Vietnam?
According to the provisions at Points a and b, Clause 4, Article 10 of Decree 144/2021/ND-CP on this content as follows:
Violations against regulations on issuance, management, use of ID cards and citizen identity cards in Vietnam
1. A warning or a fine ranging from 300.000 VND to 500.000 VND shall be imposed for any of the following violations:
a) Failure to present the ID card or citizen identity card or ID number certificate at the request of a competent person;
b) Failure to comply with regulations of law on issuance, replacement, reissuance of the citizen identity card;
c) Failure to return the ID card or citizen identity card to the competent authority upon renunciation, loss of the Vietnamese nationality or cancellation of the decision to grant the Vietnamese nationality; failure to return the ID card or citizen identity card to the authority that executes the detention order, sentences including imprisonment, compulsory education in a reform school, correctional institution or rehabilitation center.
2. A fine ranging from 1.000.000 VND to 2.000.000 VND shall be imposed for any of the following violations:
a) Appropriating, using another person's ID card or citizen identity card or ID number certificate;
b) Erasing, chancing or otherwise falsifying the ID card or citizen identity card or ID number certificate;
c) Destroying, deliberating damaging the ID card or citizen identity card or ID number certificate;
3. A fine ranging from 2.000.000 VND to 4.000.000 VND shall be imposed for any of the following violations:
a) Making, using forged documents or data in order to be granted an ID card or citizen identity card or ID number certificate;
b) Providing false information or documents in order to be granted an ID card or citizen identity card or ID number certificate.
4. A fine ranging from 4.000.000 VND to 6.000.000 VND shall be imposed for any of the following violations:
a) Forging the ID card or citizen identity card or ID number certificate; but not liable to criminal prosecution;
b) Using a forged ID card or citizen identity card or ID number certificate;
c) Pledging the ID card or citizen identity card or ID number certificate, or receiving them as pledge;
d) Buying, selling, taking or granting lease of the ID card or citizen identity card or ID number certificate;
dd) Borrowing, lending the ID card or citizen identity card or ID number certificate for commission of illegal acts.
5. Additional penalty:
Confiscation of the exhibits and means of administrative violations for the violations specified Points b and c Clause 2, Point a Clause 3, points a, b, c and d Clause 4 of this Article.
6. Remedial measures:
a) Mandatory return of the ID card or citizen identity card or ID number certificate in case of violations specified in Point a Clause 2 and Point dd Clause 4 of this Article;
b) Mandatory return of the illegal profits earned from commission of the administrative violations specified in Points a, c, d and dd Clause 4 of this Article.
Thus, individuals using a forged ID card or citizen identity card or ID number certificate may be fined from VND 4,000,000 to VND 6,000,000.
Note: The above penalty is for individuals. Organizations that commit the above violations will be fined twice as much as individuals.
Is using a forged citizen identity card punishable by imprisonment?
People using forged citizen identity cards to commit illegal acts may be examined for penal liability for using forged seals or documents of agencies or organizations in Article 341 of the 2015 Criminal Code of Vietnam (amended by clause 126 Article 1 of the 2017 Law on Amendments to the Criminal Code). To be specific:
Fabricating an organization's seal or documents and use thereof
1. Any person who fabricates an organization's seal or document or use it to commit an illegal act shall be liable to a fine of from VND 30,000,000 to VND 100,000,000 or face a penalty of up to 03 years' community sentence or 06 - 24 months' imprisonment.
2. This offence committed in any of the following circumstances carries a penalty of 02 - 05 years' imprisonment:
a) The offence is committed by an organized group;
b) The offence has been committed more than once;
c) The offence involves 02 - 05 fabricated seals or documents;
d) The fabricated seal or document is used to commit a less serious crime or a serious crime;
dd) The illegal profit earned is from VND 10,000,000 to under VND 50,000,000;
e) Dangerous recidivism.
3. This offence committed in any of the following circumstances carries a penalty of 03 - 07 years' imprisonment:
a) The offence involves ≥ 06 fabricated seals or documents;
b) The fabricated seal or document is used to commit a very serious crime or extremely serious crime;
c) The illegal profit earned is ≥ VND 50,000,000
4. The offender might also be liable to a fine of from VND 5,000,000 to VND 50,000,000.
Thus, those who commit acts of using forged citizen identity cards may be administratively sanctioned and in case there are enough elements to constitute a crime, they may be examined for penal liability with the crime of forging seals and documents of agencies and organizations; crime of using seals or forged documents of agencies or organizations as prescribed above.
