What is a lawyer? What are the criteria for lawyers in Vietnam?
In Article 2 of the Law on Lawyers 2006, lawyers are persons who fully meet the criteria and conditions for professional practice under the provisions of this Law and provide legal services at the request of individuals, agencies or organizations (hereinafter collectively referred to as clients).
In Article 10 of the Law on Lawyers 2006, the criteria for lawyers to have are:
- Vietnamese citizens who are loyal to the Fatherland,
- Observe the Constitution and law,
- Have good moral qualities,
- Possess a law bachelor diploma,
- Have been trained in legal profession,
- Have gone through the probation of legal profession
- Have good health for law practice may become lawyers.
Then, qualified people who want to practice law must obtain a law practice certificate and join a bar association.
Accordingly, Article 12 of the Law on Lawyers 2006 as amended by Clause 4, Article 1 of the Law amending and supplementing a number of articles of the Law on Lawyers 2012 provides for the training lawyers as follows:
- Holders of bachelor’s degrees in law may take a lawyer course at an institution licensed to train lawyers.
- A lawyer course lasts for 12 months.
- People that complete the lawyer course shall be issued with the Certificate of completing the lawyer course by the training institution.

What is the lawyer apprenticeship in Vietnam?
Pursuant to Article 14 of the Law on Lawyers 2006, as amended by Clause 5, Article 1 of the Law amending and supplementing a number of articles of the Law on Lawyers 2012, stipulates:
- A person that the Certificate of completing the lawyer course, and a person prescribed in Clause 2 Article 16 of this Law may serve their apprenticeship at a law-practicing organization.
+ The apprenticeship lasts for 12 months, except for the case prescribed in Clause 2 and Clause 3 Article 16 of this Law. The lawyer apprenticeship period starts from the day of registering at the Law federation.
+ The law-practicing organization shall appoint a lawyer to help the apprentice lawyer. The instructing lawyer must have at least 3 years of experience in law practicing, and not be liable for disciplinary actions as prescribed in Clause 1 Article 85 of this Law. A lawyer must not instruct more than 3 apprentices at the same time.
- A lawyer apprentice shall register the apprenticeship at a bar association in the same locality with the law-practicing organization in which they serve the apprenticeship, and be issued with the Certificate of apprentice lawyer.
The bar association shall supervise the lawyer apprenticeship.
- An apprentice lawyer may assists the lawyer in their professional activities, but may not represent, advocate, or protect the lawful rights and interests of clients in court, and may not sign written law consultancy.
The apprentice lawyer may go with the instructing lawyer to meet the detainees, suspects, defendants, victims, plaintiffs, and the people that have interests and obligations relevant to criminal lawsuits, the plaintiffs, defendants, and other litigants in civil cases and administrative lawsuits when they agree; assists the instructing lawyer in studying documents about the cases, collecting documents, items, and facts relevant to such cases, and in other professional activities; receive legal advices, non-proceedings representation, and provide other legal services assigned by the instructing lawyers upon the agreement of clients.
The instructing lawyer must supervise and be responsible for the activities of the apprentice lawyer prescribed in this Clause.
- The Minister of Justice shall specify the lawyer apprenticeship
In other words, the steps to become a Lawyer are as follows:
- Step 1: Pass the University of Law exam.
- Step 2: Obtain a Bachelor of Laws degree.
- Step 3: Take a lawyer training course (duration 12 months).
- Step 4: Apprenticeship at a law-practicing organization (duration 12 months).
- Step 5: Pass the exam to check the results of the lawyer's apprenticeship.
- Step 6: Make a dossier and send it to the Bar Association's Board of Directors to apply for a law practice certificate.
How much are the current fees for lawyer training in Vietnam?
At the Notice of Enrollment for the second 25th Law Vocational Training Class in Ho Chi Minh City and Hanoi in 2023
Specifically, on May 9, 2023, the Judicial Academy issued Notice 714/TB-HVTP to enroll the second 25th Law Vocational Training Class in Ho Chi Minh City and Hanoi in 2023, according to which:
- Form of training: Training by credit (36 credits)
- Training period: 12 months
- Target audience: People with a bachelor's degree in law or higher
- Tuition fees: Notice 714/TB-HVTP in 2023 based on Decision 1706/QD-HVTP in 2021 Download, admission fees and tuition fees for the lawyer training class at the Academy of Justice as follows:
+ Admission service fee: 200,000 VND/ 01 candidate
Tuition fees:
++For courses held in the evenings on weekdays and Saturdays and Sundays: VND 25,190,000/student/course.
++For courses held during office hours: VND 20,150,000/student/course.
Thus, the current lawyer training tuition fee ranges from 20,150,000 VND - 25,190,000 VND/student/course depending on the course chosen by the learner.
