Pursuant to Article 5 of Circular 09/2015/TT-BGTVT amended by Clause 2, Article 2 of Circular 05/2024/TT-BGTVT, regulations on methods for calculation of driving duration are as follows:
Calculation of driving duration
a) A driver’s driving duration is determined from the time on which the driver starts operating the vehicle (the vehicle starts to run);
b) If total driving duration of a driver exceeds 04 hours but the driver does not stop driving according to regulations in Clause 4 Article 11 of Decree No. 10/2020/ND-CP dated January 17, 2020 of the Government on auto transport business and conditions for auto transport business or the driver is not replaced by another driver, it will be considered as overworking.
c) If total working time of a driver exceeds 10 hours/day, it will be considered as overtime working in a day. A working day of the driver is calculated from 00h00 to 24h00;
d) The calculation shall comply with regulations in Appendix 6 issued together with this Circular.
Pursuant to Appendix IX enclosed with Circular 05/2024/TT-BGTVT, the method for calculating driving dutation as follows:
Driving duration:
a) The start of driving is determined when there are two consecutive messages with V[N] > 3 km/h.
b) The end of driving is determined when:
- The duration of stops or parking is >= 15 minutes (applicable to fixed-route vehicles, contract vehicles, tourist vehicles, freight transport vehicles, inter-provincial buses); >= 5 minutes (applicable to intra-provincial buses, taxis).
- There is a change in driver recorded by the device.
2. Calculation of driving duration violation:
a) Continuous driving duration violation: determined when the driving duration of a person exceeds 4 hours without stops or parking >= 15 minutes (applicable to fixed-route vehicles, contract vehicles, tourist vehicles, inter-provincial buses, freight transport vehicles); >= 5 minutes (applicable to intra-provincial buses, taxis) or without a change in driver.
Additional algorithm: for units with information on engine on/off as a calculation condition, in cases where the vehicle is still moving but there is no data, continuous driving duration is still calculated.
b) Daily driving duration violation: determined when the total driving duration of a person in a day exceeds 10 hours
3. Stops or parking duration:
Starts counting when there are two consecutive messages with V[N] ≤ 3 km/h and V[N-1] ≤ 3 km/h, and ends when there are two consecutive messages with V[N] > 3 km/h and V[N-1] > 3 km/h.
Therefore, the maximum driving duration for a person is determined based on the total driving duration as follows:
- Not exceeding 4 hours of continuous driving, in cases with no stops or parking >= 15 minutes (applicable to fixed-route vehicles, contract vehicles, tourist vehicles, inter-provincial buses, freight transport vehicles); >= 5 minutes (applicable to intra-provincial buses, taxis) or without a change in driver.
- Not exceeding 10 hours of work in a day, calculated from 00:00 to 24:00.

According to the regulations, drivers are not allowed to drive continuously for more than 4 hours and are not allowed to drive for more than 10 hours per day. Therefore, if drivers violate this driving duration, they will be penalized according to the provisions at point d, Clause 6, Article 23 of Decree 100/2019/ND-CP as follow:
Penalties imposed upon operators of civil and commercial passenger automobiles, and similar automobiles violating road traffic regulations

6. A fine ranging from VND 3,000,000 to VND 5,000,000 shall be imposed for:

d) Operating the vehicle beyond time limits specified in Clause 1 Article 65 of the Law on Road traffic;

What are the responsibilities of drivers of passenger cars in Vietnam?
Pursuant to Article 70 of the Law on Road Traffic 2008, it is stipulated as follows:
Responsibilities of drivers and attendants working on passenger cars
1. To check their cars’ safety conditions before setting off.
2. To show civilized and polite behaviors and guide passengers to their right seats.
3. To check the arrangement and tie up luggage and cargo to ensure safety.
4. To take measures to protect passengers’ lives, health and property, and maintain order and sanitation in their cars;
5. To close the doors before and during the time the cars move.
Thus, responsibilities of drivers of passenger cars include:
- Check their cars’ safety conditions before setting off.
- Show civilized and polite behaviors and guide passengers to their right seats.
- Check the arrangement and tie up luggage and cargo to ensure safety.
- Take measures to protect passengers’ lives, health and property, and maintain order and sanitation in their cars;
