According to point b, clause 1 Article 112 of the Labor Code 2019 regarding the number of days off for the Lunar New Year:

Public holidays

1. Employees shall be entitled to fully paid days off on the following public holidays:

a) Gregorian Calendar New Year Holiday: 01 day (the 1st of January of the Gregorian calendar);

b) Lunar New Year Holidays: 05 days;

c) Victory Day: 01 day (the 30th of April of the Gregorian calendar);

d) International Labor Day: 01 day (the 1st of May of the Gregorian calendar);

dd) National Day: 02 days (the 2nd of September of the Gregorian calendar and the previous or next day);

e) Hung Kings Commemoration Day: 01 day (the 10th of the third month of the Lunar calendar).

2. Foreign employees in Vietnam are entitled to 01 traditional public holiday and 01 National Day of their country, in addition to the public holidays stipulated in Clause 1 of this Article.

3. The Prime Minister shall decide the specific public holidays mentioned in Point b and Point dd Clause 1 of this Article on an annual basis.

According to the above regulations, employees are entitled to at least 5 days off for the Lunar New Year. In case a public holiday falls on an employee’s weekly break as, he/she will have compensatory time off on the next working days

What is the planned schedule for the Lunar New Year holiday 2024 for Vietnamese officials and public employees?

On October 27, 2023, the Ministry of Labor, Invalids and Social Affairs presented the Government of Vietnam with a proposal for Lunar New Year and National Day holidays in 2024 for officials, civil servants, public employees, and employees in governmental, administrative, political, socio-political organizations, and enterprises.

For Vietnamese officials and public employees

*Schedule for Lunar New Year holiday 2024

Plan 1:

For Vietnamese officials and public employees, the Ministry of Labor, Invalids and Social Affairs proposed, and most ministries and agencies agreed on a 5-day Lunar New Year holiday as per regulations, including 2 days before and 3 days after the New Year.

Vietnamese officials and public employees will take the Lunar New Year holiday 2024 from Thursday, February 8, 2024, to Wednesday, February 14, 2024 (i.e., from the 29th day of the last lunar month of Quy Mao year to the 5th day of the first lunar month of Giap Thin year).

With the proposed plan by the Ministry of Labor, Invalids and Social Affairs agreed upon by most ministries and agencies, Vietnamese officials and public employees will have a 7-day holiday (including 5 days of Lunar New Year and 2 compensation days for weekly rest days according to clause 3 Article 111 of the Labor Code).

In addition to the plan proposed by the Ministry of Labor, Invalids and Social Affairs and most ministries and agencies, the Ministry also presented a second plan for the Government of Vietnam to consider.

Plan 2: is to have a 5-day holiday as per regulations, with 1 day before and 4 days after the New Year.

Vietnamese officials and public employees will take the Lunar New Year holiday 2024 from Friday, February 9, 2024, to Thursday, February 15, 2024 (i.e., from the 30th day of the last lunar month of Quy Mao year to the 6th day of the first lunar month of Giap Thin year). With this plan, Vietnamese officials and public employees will also have a 7-day holiday.

Proposed plan: The Ministry of Labor, Invalids and Social Affairs proposed the Lunar New Year holiday according to Plan 1. Reason: both plans have the same number of days off, but Plan 1 ensures a balanced break before and after the New Year (this plan received consensus from all related ministries and agencies).

For employees in the enterprise sector

Based on actual conditions and the holiday schedule for Vietnamese officials and public employees, employers are encouraged to arrange the Lunar New Year and National Day holidays for their employees as follows (encouraging employers to apply the same holiday schedule for employees as for Vietnamese officials and public employees):

- For Lunar New Year 2024:+ Choose 1 day before and 4 days after the New Year or 2 days before and 3 days after the New Year or 3 days before and 2 days after the New Year.+ Notify the employees of the Lunar New Year holiday plan at least 30 days in advance.
