How many days off are there for National Day in Vietnam for students and employees in 2023?

Pursuant to the provisions of Article 112 of the Labor Code 2019 regulations on public holidays and Tet holidays are as follows:

Public holidays
1. Employees shall be entitled to fully paid days off on the following public holidays:
a) Gregorian Calendar New Year Holiday: 01 day (the 1st of January of the Gregorian calendar);
b) Lunar New Year Holidays: 05 days;
c) Victory Day: 01 day (the 30th of April of the Gregorian calendar);
d) International Labor Day: 01 day (the 1st of May of the Gregorian calendar);
dd) National Day: 02 days (the 2nd of September of the Gregorian calendar and the previous or next day);
e) Hung Kings Commemoration Day: 01 day (the 10th of the third month of the Lunar calendar).
2. Foreign employees in Vietnam are entitled to 01 traditional public holiday and 01 National Day of their country, in addition to the public holidays stipulated in Clause 1 of this Article.
3. The Prime Minister shall decide the specific public holidays mentioned in Point b and Point dd Clause 1 of this Article on an annual basis.

Accordingly, the National Day of September 2 every year will be closed on two days on September 2 of the solar calendar and one day immediately before or after.

At the same time, according to the provisions of Article 111 of the Labor Code 2019 as follows:

Weekly breaks
1. Each week an employee is entitled to a break of at least 24 consecutive hours. Where it is impossible for the employee to have a weekly day off due to the work cycle, the employer has the responsibility to ensure that on average the employee has at least 04 days off per month.
2. The employer has the right to determine and schedule the weekly breaks either on Sunday or for another fixed day in a week, which must be recorded in the internal labor regulations.
3. In case a public holiday falls on an employee’s weekly break coincide with a public holiday as prescribed in Clause 1 Article 112 of this Labor Code, he/she will have compensatory time-off on the next working days.

According to the above regulations, if the weekly rest day coincides with a public holiday or New Year, the employee is entitled to make up for the weekly rest day on the next working day.

National Day September 2, 2023 falls on a Saturday, so:

- For employees who work on Saturday, the National Day holiday of September 2, 2023 will be off for 3 days. Specifically:

+ Off on 2/9 and 01 day before (ie Friday and Saturday) and 01 day off weekly (Sunday). That is from 1/9 to 3/9

+ Or Rest on September 2 and 01 day after that (ie Saturday and Sunday), will be compensated for 01 day off on Monday of the next week. That is from 2/9 to 4/9

- For employees who do not have a working regime on Saturday, the National Day holiday of September 2, 2023 will be off for 4 days. Specifically:

+ Off on September 2 and the previous day (ie Friday and Saturday), you will be entitled to 1 day off every week (Sunday) and 1 day off on the next Monday. That is, from September 1 to September 4

+ Off on 2/9 and 01 day after that (ie Saturday and Sunday), you will have 02 days off on Monday and Tuesday of the following week. That is, from 2/9 to 5/9

Currently, there are no regulations related to the National Day holiday of September 2 for students. Therefore, students will study according to the school's schedule.

However, usually students will also have holidays according to the number of holidays that teachers and lecturers are off. Specifically:

- For schools that teach 6 days/week: students and students will have 3 days off

+ Off on 2/9 and 01 day before (ie Friday and Saturday) and 01 day off weekly (Sunday). That is from 1/9 to 3/9

+ Or Rest on September 2 and 01 day after that (ie Saturday and Sunday), will be compensated for 01 day off on Monday of the next week. That is from 2/9 to 4/9

- For schools that teach 5 days/week: students will have 4 days off

+ Off on September 2 and the previous day (ie Friday and Saturday), and be entitled to 1 day off every week (Sunday) and 1 day off on the next Monday. That is, from September 1 to September 4

+ Off on 2/9 and 01 day after that (ie Saturday and Sunday), and 02 days off on Monday and Tuesday of the following week. That is, from 2/9 to 5/9

Is there a fireworks display for National Day in Vietnam?

Pursuant to Article 11 of Decree 137/2020/ND-CP stipulates as follows:

Cases in which fireworks are allowed
1. Lunar New Year
a) Central-affiliated cities and Thua Thien Hue Province may fire high-range and short-range fireworks for no longer than 15 minutes; other provinces may fire short-range fireworks for no longer than 15 minutes;
b) Time: Lunar New Year’s Eve.
2. Hung Kings Commemoration Day
a) Phu Tho Province may fire short-range fireworks for no longer than 15 minutes at Hung’s King Temple;
b) Time: 9 p.m. of March 9 of lunar calendar.
3. Independence Day
a) Central-affiliated cities and Thua Thien Hue Province may fire high-range and short-range fireworks for no longer than 15 minutes; other provinces may fire short-range fireworks for no longer than 15 minutes;
b) Time: 9 p.m. of September 2.
4. Dien Bien Phu Victory Anniversary
a) Dien Bien Phu Province may fire short-range fireworks for no longer than 15 minutes at Dien Bien Phu City;
b) Time: 9 p.m. of May 7.
5. Liberation Day (April 30 of calendar year)
a) Hanoi City and Ho Chi Min City may fire high-range and short-range fireworks for no longer than 15 minutes;
b) Time: 9 p.m. of April 30.
6. Anniversary for liberation or establishment of provinces and central-affiliated cities.
a) Central-affiliated cities and Thua Thien Hue Province may fire high-range and short-range fireworks for no longer than 15 minutes; other provinces may fire short-range fireworks for no longer than 15 minutes;
b) Time: 9 p.m. of liberation or establishment day of provinces and central-affiliated cities.
7. National or international cultural, tourism and sports events.
8. Other cases shall be decided by the Prime Minister..

According to the above regulations, on the National Day of September 2, central-affiliated cities and Thua Thien Hue Province may fire high-range and short-range fireworks for no longer than 15 minutes; other provinces may fire short-range fireworks for no longer than 15 minutes;

How much is the salary for employees who go to work on the National Day holiday on September 2?

Pursuant to Article 98 of the Labor Code 2019 stipulates as follows:

Overtime pay, night work pay
1. An employee who works overtime will be paid an amount based on the piece rate or actual salary as follows:
a) On normal days: at least 150%;
b) On weekly days off: at least 200%;
c) During public holidays, paid leave, at least 300%, not including the daily salary during the public holidays or paid leave for employees receiving daily salaries.
2. An employee who works at night will be paid an additional amount of at least 30% of the normal salary.
3. An employee who works overtime at night will be paid, in addition to the salary specified in Clause 1 and Clause 2 of this Article, an amount of at least 20% of the day work salary of a normal day, weekend or public holiday.
4. The Government shall elaborate this Article.

Accordingly, employees who go to work on the National Day holiday on September 2 will receive at least 300% of the salary, excluding the salary for holidays, New Year's Day, and paid leave for employees who receive daily wages.

At the same time, the employee is also paid an additional 20% of the salary calculated according to the salary unit price or the salary according to the work done during the day of the working day on a public holiday if working overtime at night.
