Vietnam: How many criteria for film rating are there in 2024?

Pursuant to Clause 1, Article 3 of Circular 05/2023/TT-BVHTTDL, there are 07 criteria for film rating as follows:

(1) Theme and content;

(2) Violence;

(3) Nudity and sex;

(4) Drugs, stimulants and addictive substances;

(5) Horror;

(6) Vulgar language;

(7) Dangerous and easily imitable behavior.

What is a T18-rated film in Vietnam?

Pursuant to Article 2 of Circular 05/2023/TT-BVHTTDL, film ratings determined according to the rating criteria defined in Article 3 of Circular 05/2023/TT-BVHTTDL are arranged in ascending order as follows:

Film ratings determined according to the rating criteria defined in Article 3 herein are arranged in ascending order as follows:
1. P rated: Eligible for dissemination to viewers of all ages;
2. K rated: Eligible for dissemination to viewers under 13 years old, provided that they are with their parents or guardians;
3. T13 rated (13+): Eligible for dissemination to viewers from 13 years old or older;
4. T16 rated (16+): Eligible for dissemination to viewers from 16 years old or older;
5. T18 rated (18+): Eligible for dissemination to viewers from 18 years old or older;
6. C rated: Prohibited from dissemination.

According to the above regulations, T18-rated film is a film that is eligible for dissemination to viewers from 18 years old or older. Viewers must present documents verifying their age to watch T18-rated films.

In case of disseminating T18-rated films to the underage audiences, movie theaters may be imposed a fine as follows:

Pursuant to Point c, Clause 4, Article 8 of Decree 38/2021/ND-CP, it stipulates as follows:

4. Imposing the fine ranging from 30,000,000 dong to 40,000,000 dong for one of the following violations:

c) Disseminating movies to the audience who are not at the legitimate age or admitting the audience at inappropriate age to cinema theaters;

Thus, movie theaters disseminating T18-rated films to the underage audiences may be imposed upon a fine ranging from 30,000,000 dong to 40,000,000 dong.

Pursuant to Clause 2, Article 5 of Decree 38/2021/ND-CP amended by Clause 2, Article 1 of Decree 128/2022/ND-CP, the above fine shall be imposed on individual offenders.

Fines mentioned under Chapter II and Chapter III hereof are imposed on individual offenders, except for cases under Clauses 2, 5, 6, and 7 Article 10; Clauses 4, 5, 6, and 7 Article 10 a; Point a Clause 2, Clauses 3, 5, and 6, Points a, b, c, and d Clause 7 Article 14; Clauses 1, 2, 3, and 4 and Point b Clause 5 Article 21; Clauses 1, 2, 3, and 4 and Point b Clause 5 Article 23; Clause 1 Article 24; Articles 30, 38, 39, and 40 hereof which are imposed on organization offenders

What are the principles for film rating in Vietnam?

Pursuant to Clause 2, Article 3 of Circular 05/2023/TT-BVHTTDL, film rating as per Article 2 of Circular 05/2023/TT-BVHTTDL shall adhere to the following principles:

- Children and other vulnerable viewers must be protected from content that is inappropriate or likely to have negative impacts;

- Film rating must be based on the manner of expression; specific situations and contexts; interactivity; frequency; duration; level of detail of images, sound, lighting, and dialogue; and the level of impact on viewers, in which the importance of the context and the level of impact on viewers and listeners are priority factors in rating a film;

- A film is rated at a lower level when:

+ Its content is depicted verbally rather than visually;

+ The images of the film have a low level of impact.

- A film is rated at a more stringent level when its content:

+ Contains more details, including close-ups and slow motion;

+ Uses highlighting techniques such as lighting, perspective, and resolution;

+ Uses special effects such as light, sound, noise, resolution, color, image size, characteristics, and tones;

+ Is realistic instead of stylized;

+ Encourages interaction;

+ Has an impact at a level increased by a combination of rating factors.

- A film that is in the middle of the given ratings may be rated at a lower level if it has a way of handling the situation and the situation-handling result conveying an educational and humane message, praising moral and social values, and having positive impacts on viewers.

Vietnam: What are the time frames for screening of films for children disseminated in cinema systems and broadcasting on domestic film broadcasting television channels?

(1) Films for children disseminated in cinema systems:

Pursuant to Clause 4, Article 9, Decree 131/2022/ND-CP stipulates the time frame for the screening of films for children disseminated in cinema systems as follows:

Percentage of Vietnamese film screening sessions, Vietnamese film screening time frames, and duration and time frame of children’s films disseminated in cinema systems.

4. The time frame for the screening of films for children under 13 years old shall end before 10 pm and before 11 pm for children under 16 years old.

Thus, time frame for the screening of films for children are as follows:

- For films for children under 13 years old: end before 10 pm;

- For films for children under 16 years old: end before 11 pm;

(2) Films for children prioritized for broadcasting on domestic film broadcasting television channels:

Pursuant to Clause 4, Article 11 of Decree 131/2022/ND-CP, broadcast time frames of children’s films on domestic film broadcasting television channels are as follows:

Broadcast time ratio of Vietnamese films to foreign films, broadcast time frames of Vietnamese films, and duration and broadcast time frames of children’s films on domestic film broadcasting television channels.

4. Children's films shall be prioritized for broadcasting during the time frame from 6 pm to 22 pm. The broadcasting duration of films for children under 16 years old shall reach at least 5% compared to the total broadcasting duration on domestic television channels.
