How many criteria are applied for the classification of official job positions in Vietnam?

Based on Article 5 of Decree 62/2020/ND-CP, the classification of official job positions is performed according to 02 criteria: Volume of work - Nature and content of work.

To be specific, as follows:

Classification of job positions

1. Classification by volume of work

a) Job positions handled by one person;

b) Job positions handled by multiple persons;

c) Concurrent job positions.

2. Classification by nature and content of work

a) Leadership and management job positions;

b) Specialized professional job positions;

c) General professional job positions (finance, planning and investment, inspection, legal affairs, international cooperation, organization and personnel, emulation and commendation, office management, and other specific job positions);

d) Support and service job positions.

Thus, the classification of official job positions is performed according to the volume of work and the nature and content of the work.

What is the process for approving job positions in Vietnam?

Based on the provisions of Article 7 of Decree 62/2020/ND-CP, it is specified as follows:

Procedure for approving job positions

1. The agencies and organizations under ministries, ministry-level agencies, agencies under the Government of Vietnam, organizations established by the Government of Vietnam or the Prime Minister that are not public service providers, provincial and municipal People's Committees (hereinafter referred to as ministries, central authorities, and local authorities), based on Clause 1, Article 4 of this Decree and guidelines from the competent authority on job positions, shall develop their job position schemes and send them to the agencies and organizations specified in Clause 2 of this Article for appraisal.

2. The agencies and organizations responsible for organizational and personnel matters of the ministries, central authorities, and local authorities shall receive the dossier, appraise the job position scheme, compile the job positions of the agencies and organizations under the ministries, central authorities, and local authorities, and submit it to the competent authority for approval as specified in Clause 3 of this Article.

3. The heads of ministries, central authorities, and local authorities shall approve the job positions within the agencies and organizations under their management.

Thus, currently, the process for approving official job positions is carried out in the following order:

- Develop the job position scheme;

- Receive the dossier, appraise the job position scheme, compile the job positions;

- Approve the job positions.

What is the current stipulated period for appraising job position schemes?

According to Article 8 of Decree 62/2020/ND-CP, the period is specified as follows:

Dossier submission, content, and period for appraising the job position scheme of an agency or organization

1. The dossier for submitting the job position scheme includes:

a) The request for approval of the job position scheme;

b) Job position scheme;

c) Copies of documents from competent authorities stipulating the functions, tasks, powers, and organizational structure of the agency or organization; professional management procedures according to specialized laws.

2. Content of the job position scheme

a) The legal basis for developing the job position scheme;

b) Statistics and classification of jobs according to functions, tasks, nature, and complexity of each job in the agency or organization;

c) Determination of job positions, including: Job descriptions, competency frameworks, official ranks for each job position;

d) Compilation of job positions and official rank structures of the agency or organization;

dd) Recommendations, proposals (if any).

3. Appraisal content:

a) Dossier for submitting the job position scheme;

b) The legal basis for developing the job position scheme;

c) Job positions and the official rank structure of the agency or organization.

4. Appraisal period:

Within 40 working days (for the first-time submission), 25 working days (for adjustment submissions) from the date of receiving a complete dossier, the agency or organization assigned the responsibility for appraising the job position scheme specified in Clause 2, Article 7 of this Decree must complete the appraisal and submit it to the competent authority for consideration and decision. If the competent authority requires adjustments or does not agree, the agency or organization assigned the responsibility for appraisal must notify in writing and specify the reasons.

Thus, the period for appraising the job position scheme is defined as follows:

- For the first-time submission: 40 working days from the date of receiving a complete dossier;

- For adjustment submissions: 25 working days from the date of receiving a complete dossier.
