In Article 8 of the Law on People's Public Security2018, the obligation to join the People's Public Security is stipulated as follows:

Obligations to join the People's Public Security

1. Citizens performing the duty of joining the People's Public Security fulfill the obligation to protect the homeland within the people's armed forces. Every year, the People's Public Security recruits citizens of conscription age to serve in the People's Public Security for a term of 24 months. The Minister of Public Security decides to extend the active service period of non-commissioned officers and duty soldiers but not exceeding 06 months in the following cases:

a) To ensure combat readiness tasks;

b) While performing duties of disaster prevention, epidemic control, rescue, and relief.

2. The citizen recruitment procedure to perform the duty of joining the People's Public Security is applied as for selecting citizens for active military service.

3. The Government of Vietnam stipulates details regarding clause 2 of this Article.

Thus, according to the above regulation, the People's Public Security recruits citizens of conscription age to serve in the People's Public Security for a term of 24 months.

However, in certain cases mentioned above, the Minister of Public Security can decide to extend the service period of non-commissioned officers, duty soldiers but not exceeding 06 months.

Shall citizens performing police duty perform military service?

Clause 3, Article 4 of the Military Service Law 2015 stipulates the implementation of military service as follows:

Military Service

1. Military service is the glorious duty of citizens serving in the People's Army. Performing military service includes active service and reserve service in the People's Army.

2. Citizens of military service age, irrespective of ethnicity, social class, belief, religion, educational level, occupation, or residence must perform military service as stipulated by this Law.

3. Citizens serving in the Coast Guard and performing the duty of joining the People's Public Security are considered as performing active military service.

4. Citizens in one of the following cases are recognized as having completed active military service during peacetime:

a) Full-time militia members with at least 24 months of service are recognized as having completed active military service during peacetime as decided by the Commander of the District Military Command upon the proposal of the President of the Commune People's Committee or village head where there is no commune administrative unit, or the head of the agency or organization;

b) Completing the duty of participating in the commune police continuously for at least 36 months;

c) Officials and public employees, university graduates or higher, who have been trained and commissioned as reserve officers;

d) Young people who volunteer to serve at economic-defense units for at least 24 months as per a scheme decided by the Prime Minister of the Government of Vietnam;

dd) Citizens serving on fisheries patrol boats for at least 24 months.

According to the above regulation, citizens performing the duty of joining the People's Public Security are considered as performing active military service. Therefore, citizens who have performed police duty are not required to perform military service.

How much are discharge allowances for non-commissioned officiers in Vietnam?

According to Article 7 of Decree 27/2016/ND-CP, policies on one-time discharge allowances, job creation allowances, travel money, travel allowances for non-commissioned officers, discharged soldiers, police duty receive the following amounts of money upon discharge:

* One-time Discharge Allowance

- Each year of service is entitled to an allowance equal to 02 months of the statutory pay rate as stipulated by the Government of Vietnam at the time of discharge.

The current statutory pay rate: 1,800,000 VND (according to Decree 24/2023/ND-CP, the statutory pay rate is expected to apply until July 1, 2024). Currently, the typical duration for police duty is 02 years.

Thus, at the time of discharge, the allowance received is: 7,200,000 VND (for 02 years of police duty).

- In cases where there are odd months, it's calculated as follows:

+ Under 01 month does not receive the discharge allowance.

+ From 01 month to 06 months receives an allowance of 01 month's statutory pay rate.

+ From more than 06 months to 12 months receives an allowance of 02 months' statutory pay rate.

* 2 Months Current Rank Allowance

Duty police officers serving for a full 30 months are entitled to an additional 02 months of current rank allowance upon discharge.

In cases of discharge before 30 months, the service period from the 25th month to under 30 months is entitled to an additional 01 month of current rank allowance.

* Job Creation Allowance

Duty police officers who complete their service as stipulated are entitled to a job creation allowance equal to 06 months of the statutory pay rate as stipulated by the Government of Vietnam at the time of discharge.

1,800,000*6 = 10,800,000 VND.

* Travel money (standard type) and travel allowance from the unit to the place of residence

Duty police officers upon discharge are organized by the direct management unit for a farewell meeting before discharge, with a cost of 50,000 VND/person.

Duty police officers are sent off and taken back to their local places of residence as stipulated or are given travel money (standard type) and travel allowance from the unit to the place of residence.
